My friend is not a spy!
On January 10th, 2013, my friend, Yoo Woo-sung who is a North Korean defector with a status of Chinese descendant was suspected as a North Korean spy while he was working as a city public officer in Seoul. He was put in solitary confinement of 5㎡ for 8 months. He spent the days without freedom being watched by CCTV for 24 hours a day. On August 22th, 2013, he was finally acquitted of all the suspicions of violating National Security Law and released. However, by an appeal of the prosecution, he has again been put on trial until now. In the court of appeals, the prosecution and NIS show miserable mockery of governmental authority, losing fairness and justice by submitting forged offical documents as evidence. When submitted to the Chinese embassy, they officially announced that these documents are forgeries.
지난 2013년 1월 10일 서울 시청에 근무하던 화교출신 탈북자, 저의 친구 유우성은 북한의 간첩이라는 혐의를 받았습니다. 구치소에 감금되어 8개월 동안 1.5평 남짓한 좁은 구치소 독방에 갇혀있었습니다. 그는 카메라에 24시간 감시당하며 자유를 박탈당하고 인생을 빼앗긴 채 억울한 기간을 보냈습니다. 2013년 8월 22일 우성이는 간첩이라는「국가보안법」 위반 혐의 전부에 대하여 무죄를 선고받고 비로소 자유의 몸이 되었습니다. 이후 검찰의 항소로 인하여 2014년 3월13일 현재까지 재판 중에 있습니다. 그러나 항소심에서 검찰과 국정원은 공문서를 위조하여 증거를 제출하는 등 정의와 공평을 잃은 공권력의 비참한 모습을 보여주고 있습니다
In spite of this, the prosecution organized an investigation team to reveal the truth of the forgery scandal of the official documents. The justice department accepted the position of the prosecution who claims to continue the trial after the result is reported and extended the date for the final trial. However, such inquiries about process and punishment for the forgery are irrelevant with Woo-sung's trial since the fact obviously remains that the evidence are manipulated. Nevertheless, the trial has been extended and it causes pain mentally and physically to Woo-sung who is currently under psychiatric help. It also is causing much undue stress to his family.
이에 검찰은 공문서 위조 사건에 대한 진상을 규명하는 조사팀을 구성하여 움직이고 있으며, 조사결과를 보고 재판을 계속하자는 검찰 측의 입장을 재판부가 받아들여 결심기일을 두 번이나 연장하고 있는 실정입니다.이러한 진상규명은 증거를 조작한 것에 대한 처벌과 과정에 대한 조사로써 증거가 조작되었다는 사실에는 변함이 없음으로, 본 사건의 재판과 아무런 상관관계가 없는 것입니다. 그럼에도 불구하고 재판은 계속 연장되어 정신과 치료를 받고 있는 유우성과 건강이 좋지 않은 그의 아버지와 동생 등 가족에게 정신·육체적으로 커다란 고통만 지속시키고 있는 결과만을 초래하고 있습니다.
Though the ethnicity of my friend Woo-sung is Chinese, he was born in North Korea to a Korean mother and grew up like any other North Korean in North Korea and has shared the pain of those experiences with them. There are many people who spoke highly of his sincerity and nature among his fellows at Yonsei university, and he was also esteemed among his coworkers at Seoul Metropolitan City Hall. My friends and I who have been with him for many years, do not think that he is a spy. Whether Chinese, North Korean or South Korean, no one should not be unjustly convicted of a spy with fabricated evidence and the fundamental human rights must be protected.
저의 친구 유우성은 비록 중국인 화교이지만, 다른 탈북자들과 마찬가지로 북한에서 태어나 북한주민들과 똑같이 교육을 받고 생활하면서 어려운 북한에서 태어난 친구들과 고통을 함께 나누기도 하였습니다. 그가 한국에 온 이후로 연세대학교에서 함께 공부하던 학우들 중에는 그의 성실함과 인간성을 칭찬하는 이들이 많으며, 그가 근무하고 관여했던 기관들에서도 그에 대한 평가도 긍정적이었습니다. 그런 그와 오랫동안 함께 알고 지내온 저희들은 유우성을 간첩이라고 생각하지 않습니다. 중국사람이든, 북한사람이든, 한국사람이든, 그 누구에게도 간첩이라는 죄를 뒤집어 씌어서는 안되며, 인간의 기본적인 권리는 마땅히 지켜져야 할 것입니다.
따라서 유우성의 친구들인 저희들은 유우성의 간첩혐의에 대하여 무죄임을 다시 한 번 강력히 주장하며, 무고한 한 청년의 인생이 더 이상 희생당하지 않도록 하기 위하여 여러분들의 서명을 부탁드립니다. 서명이 완료되는 대로 국가인권위원회는 물론, 유엔인권이사회, 유럽 인권관련 국제기구들과 한국주재 각국 대사관과 함께 박근혜 대통령과 오바마 대통령에게도 전달하려고 합니다. 우리 선배들이 피로서 쟁취한 산업화와 민주화가 손상되지 않고 더욱 빛이 나게 하여, 우리나라 대한민국이 진정한 자유와 민주주의가 보장되는 선진국이 되어 무고한 사람들이 공권력의 피해자가 되는 일들이 없는 날을 위해 함께 힘을 모아주시기를 부탁드립니다.
Therefore, we as his friends, firmly assert his innocence from the suspicion of a spy and ask all of you to sign the petition for an innocent young man not to be sacrificed for political reasons. We plan to deliver it to National Human Rights Commission and also to UN Human Rights Council, European international organizations related to the human rights, and the Korean embassies in each country and to president Park Geun-hye, and president Obama as soon as the signatures are gathered. We hope to gather together to make the just society which no innocent people be a victim under public power and the true democratic society which guarantees freedom securing the values that our ancestors achieved by their blood.

平成25年1月10日、ソウル市役所に勤務していた華僑出身の脱北者である私の友人ユ・ウソンが北朝鮮のスパイだという嫌疑を受けました。彼は拘置所に監禁され、8ヶ月の間、5㎡ほどの狭い独房に拘置されていました。彼は24時間監視されながら、自由を剥奪され、人生を奪われたまま、無念の期間を送りました。 25年8月22日、ウソンはスパイという「国家保安法」違反の容疑について無罪を宣告され、初めて自由の身になりました。以降、検察の控訴により、 26年3月13日現在、裁判は継続中です。しかし、控訴審で検察と国家情報院は、公文書を偽造して証拠として提出するなど、正義と公平を見失った公権力の悲惨な姿を見せています。
検察は内部において、公文書偽造事件の真相を究明する調査チームを構成して動いており、その調査結果を見た上で裁判の継続を判断しようという検察側の立場を裁判所が受け入れ、開廷期日を二回も延長しているのが実情です。これらの「真相究明」は、証拠が操作された過程とそのことに対する処罰に関する調査が目的であり、証拠が操作されたことそのものに変わりはありませんで、この事件の裁判と全く関係がありません。にもかかわらず裁判は継続して延長され、心療内科の治療を受けているウソンの健康状態を悪化させ、加えて彼の父や弟など家族にまでも精神的·肉体的に大きな苦痛を持続させている結果だけをもたらしています。
私の友人であるこのウソンは中国籍ではありますが、他の脱北者と同様、北朝鮮で生まれ、北朝鮮の住民と同じように教育を受け、生活に苦しい北朝鮮で生まれた友人たちと痛みを分かち合ってきました。彼が韓国に来て以来、延世大学校で一緒に勉強していた学友の中には、彼の誠実さと人間性を賞賛する人々が多く、彼が勤務し関与してきた機関でも、軒並み肯定的な評価を受けて来ています。そんな彼と長い間一緒に知って過ごしてきた私たちは、ウソンをスパイだとはとても思っていません。中国の人でも、北朝鮮人でも、韓国人でも、何人もスパイという濡れ衣を着せられてはならず、基本的人権は、当然守られるべきでしょう。
ウソンの友人である私たちは、ウソンのスパイ容疑について無罪であることを再び強く主張し、罪のない一人の青年の人生がこれ以上犠牲に遭わないようにするため、皆さんの署名をお願いすることになりました。署名はまとまり次第、国家人権委員会はもちろん、国連人権理事会、欧州人権関連の国際機関と韓国駐在の各国大使館、朴槿恵大統領、さらにオバマ米大統領にも伝えようとしています。私たちの先人たちが血で勝ち取った産業化と民主化が損なわれず、さらに輝かしいものとし、大韓民国が真の自由と民主主義が保障される先進国として、罪のない人々が公権力の犠牲者になることがない日を実現するために、お力添えいただきますようよろしくお願いいたします。
