Bobbie Wade Richards has spent over a decade in prison for crimes he didn’t commit, convicted solely on false testimony from admitted perpetrators who later confessed to lying. Despite new evidence, all appeals and a Writ of Innocence have been denied, leaving Bobbie with no legal options.
Bobbie took his case to trial, presenting his evidence of innocence under the guidance of an attorney who failed to adequately prepare his defense witnesses. This lack of preparation caused his witnesses to become nervous and deliver conflicting statements in court, leading to his conviction and a devastating 37-year sentence with no time suspended. This sentence was far outside the guidelines, a direct result of the "trial penalty" imposed by a jury of his peers. Meanwhile, the co-defendants who testified against Bobbie have already served their time and been released, receiving significantly shorter sentences.
The new evidence of redacted testimonies—proving Bobbie’s innocence—was dismissed by the prosecution as "not credible" due to the witnesses’ state of mind and substance abuse. However, these same witnesses were considered credible enough to convict Bobbie in the first place. Make it make sense!
The "trial penalty" has discouraged many charged offenders from exercising their Sixth Amendment right to trial, forcing them to accept plea deals rather than risk extreme sentencing. Bobbie stood by his innocence and is now paying the price for choosing a trial over a plea deal.
While incarcerated, Bobbie has worked tirelessly to improve himself—earning certifications and seeking education and training with his family’s support outside the DOC. He is determined to reunite with his children, rejoin the workforce, and start fresh as a father, worker, and contributing member of society.
