The Issue

NOTE: BEFORE READING THE BELOW FOLLOWING CASE, TAKE INTO CONSIDERATION THAT THE PETITIONER (MYSELF), PASSED OVER 60 EXAMS AT TAFT LAW SCHOOL OVER A TWO-YEAR PERIOD: 30 EXAMS IN THE FIRST YEAR (ONLY FAILING ONE), AND 30 EXAMS IN THE SECOND YEAR (NOT FAILING ANY); YET, TAFT LAW SCHOOL ACADEMICALLY DISMISSED ME IN THE FIRST YEAR (WAS THEN PLACED ON PROBATION IN THE SECOND YEAR), AND PASSED THE PROBATION PERIOD FAILING NO EXAMS WHATSOEVER. Comes Now, Roger Scott Blackburn, Pro Se, and shows the following in support of this petition and complaint:

                                                    FACTS OF CASE:

On August 27th, 2020, the petitioner in this case wrote the Dean of his Law School, Dean Robert Strouse, and voiced his concerns in regard to this issue. However, nothing positive came out of the correspondence. The petitioner’s concern is that he passed the entire year of his first Law School studies, every single exam and test, except for the Final Exam at the end of the year. As a result, the school did not give the petitioner credit for the exams and test that he did pass over the entire year, except for Legal Writing, and we believe one other. Their claim is that if you do not pass the Final Exam at the end of the year, then you do not get credit for the year or anything that you did pass. We understand that this may be the policy perhaps in California, but this policy is not ethical in our opinion, as no other college major deprives a student of the credits that he or she rightfully earned on their transcripts. Every single university or college across America rightfully grants a GPA for grades passed by the student on their transcripts. The petitioner has not asked for anything that he did not earn. But as you can see by the attached exhibit/email, “Exhibit A” that the petitioner sent to Dean Strouse, the petitioner passed every single exam and test throughout the
entire year at Taft Law School. The only one the petitioner failed was the Final Exam, as mentioned in the foregoing. However, the petitioner also even filed a complaint in regard to this, as the proxy who gave the petitioner the Final Exam had allowed other individuals to enter the testing room while talking loudly, as well as even allowed them to pop popcorn in a Microwave, that was only a few feet from where the petitioner was sitting taking the exam. Nothing was ever done about this, and the petitioner eventually withdrew from the Law School at a later date to pursue a teaching career. The petitioner has never been given credit on his transcripts for the 30 plus exams and test that he passed, nor will Taft Law School grant the petitioner the right to demonstrate his GPA on his Law Transcripts. This has caused the petitioner problems even trying to enrol at times in other colleges, because the other colleges do not have any idea what the petitioner’s GPA is from Taft Law School. This is just simply wrong to do a student this way, as the petitioner’s GPA is we believe a 3.0 even with failing the Final Exam, because he has around 30 passing grades. At the very least, the petitioner should be granted credit for what he has passed, just like any other college, and then simply have to retake any Final Exam to move forward. However, this did not happen. The petitioner spent $40,000 plus U.S. Dollars for these Law Studies at Taft Law School, for basically nothing, and not even being granted credit for what he did pass and deserve, just to have the Law School academically dismiss the petitioner unjustly. This is unjust because the petitioner was making academic progress the entire year ... and never failed a single exam or test until the Final Exam. To academically dismiss the petitioner for the entire year on the grounds of failing only one exam, is even a violation of Federal Law if you consider what the U.S. Department of Education's Policy is for being academically dismissed. The Department of Education’s policy, again, for grounds to be academically dismissed, is that the student is not making academic progress. This did not happen or take place in the petitioner’s case, because again, he never failed any exam or test throughout the entire year. Therefore, Taft Law School in all reality violated the Department of Education’s Federal Rules and Guidelines by academically dismissing the petitioner for the entire year, based on one exam. NOT ETHICAL!

The foregoing considered, the petitioner is petitioning the California State Bar to lift this policy of failing a California Law Student merely on the basis of a Final Exam at the end of the year; or at the very least, give the student the credits on his or her transcripts that they actually passed, so that a GPA will show on the student's transcripts. Note: If a California Law Student fails the California State Bar Exam after three years of Law School, they still retain their Law Credits, but simply have to retake the Bar Exam. The petitioner’s case should mirror this same scenario, because their is no ethical grounds for deleting his 30 plus passed law exams and tests, simply on the basis of failing one final exam at the end of the year.

Premises Considered, we/the petitioner are requesting that the academic dismissal that was wrongly levied against the petitioner be reversed, and that the petitioner’s true GPA be reinstated on his Taft Law School transcripts.

The foregoing considered Dean Strouse, I successfully passed 30 assignments and exams to date (one for each week of the 30 weeks of the second year at Taft Law School). This is 30 weeks of passing grades at Taft Law School. Most of these grades in the foregoing, are in fact, A and B
grades, with a few C pluses, and a couple of regular Cs. Question: Why was I only granted 4 credits for the second year at Taft Law School? I have been thinking about bringing this to the attention of the California State Bar, as I do not think it is fair. However, I wanted to give you a chance to address the issue first, as is common administrative due process. For some reason Taft Law School does not publish the GPA and grades until the end of the
program. However, a student needs to have their present grades and GPA visible throughout the year, in the event they want to transfer to another college. The fact that Taft does not post the GPA and present grades of the student on the transcript, makes it look like the student has no GPA or
grade, which is misleading to the other college that the student is transferring to. Most colleges want to see what the student's GPA is when they transfer, and with the Taft scenario, this can certainly cause complications. Note: My entire second year at Taft was passing, so why do they only have 4 credits earned on the transcript? I passed every single exam and assignment in the second year throughout the year, for 30 Weeks, yet Taft only placed 4 earned credits on the transcript for the 30 weeks, yet I did not fail one course.

grades, with a few C pluses, and a couple of regular Cs. Question: Why was I only granted 4 credits for the second year at Taft Law School? I have been thinking about bringing this to the attention of the California State Bar, as I do not think it is fair. However, I wanted to give you a chance to address the issue first, as is common administrative due process. For some reason Taft Law School does not publish the GPA and grades until the end of the
program. However, a student needs to have their present grades and GPA visible throughout the year, in the event they want to transfer to another college. The fact that Taft does not post the GPA and present grades of the student on the transcript, makes it look like the student has no GPA or
grade, which is misleading to the other college that the student is transferring to. Most colleges want to see what the student's GPA is when they transfer, and with the Taft scenario, this can certainly cause complications. Note: My entire second year at Taft was passing, so why do they only have 4 credits earned on the transcript? I passed every single exam and assignment in the second year throughout the year, for 30 Weeks, yet Taft only placed 4 earned credits on the transcript for the 30 weeks, yet I did not fail one course.

P.S. Can you please provide me with an Official Transcript that states my grades and GPA on it, giving me proper credit for all the courses and assignments that I successfully passed?

Please sign the petition and demand that Taft Law School and the California State Bar stop this practice of withholding Law Student's Transcripts and forward this petition to your State Representatives and demand action.
