Support the Bill. Help Stop False Allegations in Custody Cases/Family Court

The Issue

 

In high conflict marriages, separations and divorce proceedings one parent may utilize false allegations of abuse to achieve custody of the children.  In 2020, The Center for Prosecutor Integrity released a report stating 8% of adult Americans have been falsely accused of child abuse, roughly 20.4 million adult Americans!!! 27% of those allegations were made in family court, this equates to 5.5 million adult Americans being falsely accused of child abuse in family court.   The consequences of parents who are falsely accused suffer from not only seeing their child but with cumbersome legal expenses and emotional damages.  There are cases in which a falsely accused parent hasn't seen their children is months or even years!!!

I've spent the past two years interviewing former judges and prosecutors, victims of abuse, victims of false allegations of abuse, expert witnesses/psychologists and numerous non-profit pro-family organizations.  My international interviews concludes that false allegations of abuse are not isolated incidents and does not discriminate against gender, parents or grandparents.

Currently I've drafted a proposed law in the state of Pennsylvania providing remedies to the victims of false allegations of abuse.  Under the proposed bill victims of false allegations of abuse may seek the following remedies:
1.  All medical expenses compensated, such as child reunification therapy and indvidual therapies for both the parent and child.
2.  All court cost and attorney fee's relating to the defense of the false allegations.
3.  Any loss of income/emotional distress or harm to reputation because of the false allegations.

 Furthermore, I am strengthening the proposed law to protect actual victims of abuse.  The proposed bill has a three tier process which protects victims of actual abuse.  The three tier verification process in which a person can use this law states:
1. The initial allegations are dismissed, unfounded or proved "not guilty".
2. Upon a dismissal of the allegations a proximity safety measure wasn't included. (For instance, a plea bargain of not going to trial in leu of attending abusive awareness course.)
3.  Lack of evidence to substantiate the claim of abuse.
All three ties must be satisfied as a prerequisite upon using the proposed civil remedy.
