The Issue

This is a personal issue for me and something I feel very strongly about. Some Grandparents  are weaponizing the court system as a tactic to undermine parental authority and over step healthy boundaries. This causes an even more dysfunctional dynamic to family, financial burden and unnecessary stress. We need a change. 

Imagine that you were always the only parent responsible for your child, financially, educationally, medically, and in every aspect and capacity in which a parent is to provide. Then imagine someone suing you for rights to YOUR child because you said NO to unsupervised visitation.  Imagine saying NO, I’m not comfortable with this and then being threatened. Imagine your family being out thousands of dollars in lawyer fees for a case that shouldn’t be able to happen. My 14th amendment rights shouldn’t just apply to paper, I’m disappointed in our legal system and I’m not alone. Many parents like myself are fighting for a change. 


Kentucky's current law, KRS 405.021, allows grandparents in our state to petition the court for visitation rights even when a child's fit and capable parents oppose it. While grandparents can play a crucial role in a child's life, it is equally important to respect the rights of fit parents to decide what is best for their own children.

Under the present legislation, courts can grant visitation rights to grandparents regardless of the wishes of the child's custodial parents. This often leads to legal disputes that place emotional and financial burdens on families, while disregarding the decisions made by parents who are fit to decide what is best for their children. We must stop allowing court interventions that undermine the familial bonds between parents and their children when it is not in the best interest of the child.

Statistics have shown that consistent parental involvement is key to the healthy development of children. Conversely, court disputes can disrupt the stability necessary for growth and well-being. Kentucky laws need reform to ensure that children's lives remain stable and that parental rights are upheld.

I propose a change to KRS 405.021 to better align grandparents' rights with the realities faced by families today. Grandparents should only be allowed to petition for visitation rights under specific circumstances:

1. BOTH parents are incapacitated, imprisoned, or deceased.
2. The grandparent has been the primary caregiver of a grandchild for six months or more without the presence of a parent or legal guardian.

This would protect the interests of the children by allowing only those grandparents who truly have an established role and necessity in the child's life to seek such rights. This amendment not only respects the rights of capable parents but also ensures that judicial interventions are reserved for instances where they are entirely necessary.
