HELP CHANGE THE HOA'S BYLAWS THAT RESTRICT PROFESSIONAL SWIM LESSONS

The Issue

I am Miss Selenia. I am a professional swim instructor that travels from pool to pool to teach others how to swim. I have been of service as a traveling instructor since Covid began.

Often, I am asked to come out to a community pool and teach a private lesson.

The home owner/renter has access to the community pool during regular hours, they allow me access in and I begin my lesson. This shouldn't be an issue, however...

Have you checked your bylaws lately? Probably not. It isn't a sexy read. However, you might be breaking the rules.

If you are a homeowner/renter you may be surprised to learn that inside your HOA's bylaws there is a stipulation that restricts hiring a professional to teach swim in the community pool. It is within the legal right of the HOA to issue fines to the owner and police can issue trespassing charges to the instructor if discovered breaking this bylaw. These are extreme measures to dissuade residents to have such activities performed at the community pool. But recreationally you can have a pool party without a lifeguard or restriction where people may or may not know how to swim safely.

According to the National Drowning Prevention Alliance, there are an average of 3,960 fatal unintentional drownings (FUDs) in the United States each year. Of these, 1,037 are children aged 14 and under. About 1 in 5 FUDs occur in swimming pools or other recreational water settings. The number of HOA community pool drownings is not tracked separately, but it is likely a small percentage of the overall number of drownings. However, any drowning is a tragedy, and it is important to take steps to prevent them. 

In 2023, there is no good reason a homeowner/renter that pays HOA dues each month or annually for the maintenance and service of the pool and its grounds, to be denied and potentially fined, should they desire to learn how to swim in it. 

I am in California, so I am starting here at home, but I know other states that also have this old resolution in their bylaws that need to change.

My goal is to start the conversation and shine a light on this issue and if it were up to me I would require all HOAs with community pools to offer summer swim lessons to any homeowner willing to participate. At bare minimum don't disallow the important service of swim lessons.

The goal here is not to hate on HOA's but to show them how to be of service and not a hindrance of human progress. I want to create more capable and safe swimmers and be a support system to prevent drownings.
