Brief summary: Hearing set for Oct 28th in front of the Douglas County Board of County Commissioners [BOCC] @ 2:30pm on 100 Third Street in Castle Rock.  The developer is still requesting to build two and a half times the number of houses that the land is current zoned for. They are stuck at requesting to build 38 houses.  Recall, the property is currently zoned for 15 equestrian properties each on 2.5 acres.

Please join us on Oct 28th, wearing red in a show of solidarity to come together as a community and once again request that the commissioners REJECT the MAJOR REZONING and support maintaining this beautiful land as it is currently zoned for.  15 equestrian properties on 2.5 acres. See recent update on our July 22nd hearing (which we only had 3 weeks to prepare for due to the developer quickly scheduling a hearing in the middle of the summer). The hearing to decide if the 47 acres adjacent to the CO Horse Park maintains its current zoning for 25 equestrian properties, ended with the Douglas County BOCC ‘tabling’ a vote AGAIN!

Brief summary:

  • the developer (Pinery 40 LLC) never reached out to the community like the commissioners asked them to to discuss a compromise or discuss their resistance to the current zoning for 15 amazing properties. 
  • the developer dropped their plan by a whopping 1 home (44 instead of 44)
  • the developer seemed to have plenty of time to meet with the county to show a plan to plopp a barn in the middle of the 44 homes.
  • there is no viable road access for horse or hay trailers to the barn.
  • there is no clear plan for paying for the barn. It would be left up to a future homeowners association. 
  • only 20 horses could board in the barn. Meaning only 20 of the 44 hones could keep a horse at this barn that is not accessible or budgeted for.
  • only 8 of the 44 homes have direct access to the barn.

Note, public comment was stopped halfway through, meaning 10+ residents were not allowed to give the 3 minute opposition speech we prepared.  Before a quick 180 to ‘table’ a vote, two of our county commissioners (Van Winkle, Layton) were voting no to this rezone, in support of our community, and honoring the Major Rezoning Amendment Criteria. I just hope they stay courageous and keep this kind at the current zoning. 15 equestrian properties each on 2.5 acres  

Preserve Colorado’s western heritage. Honor the intent of these 47 acres. Save this last if it’s kind land in the Timbers in Parker. Honor Helen Krieble.

MAJOR REZONING BOARD OF COUNTY COMMISSIONERS (BOCC) HAVE ASKED TO “table this project” and did not chose to take a vote, despite all agreeing the developer DID NOT meet required Major Rezoning amendment criteria (especially .03, see below). They would have voted “no” in our favor IF THEY VOTED late last night!” That was their task, but no vote.

PLEASE CALL 303-660-7401 or email bocc@douglas.co.us  to express “Support for Project #2023-003. Reject Major Rezoning. Maintain the current zoning for 15 equestrian estates on 2 1/2 acres.”  Imagine if the commissioners received 1000+ emails or messages!

Our community and this Change.org community have been amazing. Your responses were added to the public record. Last night we had more than 20 speakers prepared, passionate, and outspoken about maintaining the current zoning for 15 Equestrian Properties on the 47 Acres adjacent to the historic Parker Colorado Horse Park (CHP).  We intend to maintain our stance to adhere to the current zoning! 

The three Douglas county commissioners- Layton, Teal, Van Winkle asked to “table the project” to have another Town Hall meeting (our 4th). Why?!?!   We have already had three meetings.

BACKGROUND

Project name: Pinery Planned Development 31st – Major PD Amendment.  Project number/Filing number ZR2023-002. 

Russell Hall and his Pinery 40 LLC purchased the 47-acre prairie property adjacent to the Colorado Horse Park [CHP] in Nov/Dec 2022 for $2,500,000.00.  They have submitted proposals for a “major rezone” to the current zoning. Currently this beautiful land is zoned for 15 Equestrian Estate properties on 2.5 acres (possibly up to 4.9). This was Helen Krieble's (who created the CO Horse Park) vision and she made sure to keep this zoning in place.  Helen passed away in June 2021.  Pinery 40 LLC wants to triple this number of houses (45 houses) and eliminate equestrian properties!  Dishonoring her vision & legacy AND without meeting Major Rezoning Amendment criteria. (See below)  

1520 Major Amendment - Approval Criteria:  "The following criteria shall be considered by the Board for approval of the major amendment." 

1.     DCZR 1520.01 Whether the amendment is consistent with the development standards, commitments, and overall intent of the planned development. 

2.     DCZR 1520.02 Whether the amendment is consistent with the intent, efficient development and preservation of the entire planned development. 

3.     DCZR 1520.03 Whether the amendment will adversely affect the public interest or enjoyment of the adjacent land. 

4.     DCZR 1520.04 -Whether the sole purpose of the amendment is to confer a special benefit upon an individual. 

5.     DCZR 1520.05 - Whether the amendment is consistent with the water supply standards. 

6.     DCZR 1520.06 - Whether the public facilities and services necessary to accommodate the proposed development will be available concurrently with the impacts of such development. 

7.     DCZR 1520.07 - Whether the roadway capacity necessary to maintain the adopted roadway level of service for the proposed development will be available concurrently with the impacts of such development.
