PETITION through this petition, comes Petitioner, Chanelle S. Tippy, a major resident of the State of Louisiana, who respectfully represents:
Made defendant herein is Justin Nathan, whose full address is to be provided upon service.
On or about [Febuary 21,2025], petitioner purchased a vehicle from defendant after being assured the vehicle was in good condition and safe to operate.
Prior to paying for the vehicle, petitioner specifically asked defendant if there was anything wrong with the vehicle. Defendant stated there was “nothing wrong” with the vehicle and allowed petitioner to test drive it before purchase.
Shortly after purchasing the vehicles of the noise he said nothing me leaving and arriving home with petitioner’s children, serious mechanical problems became apparent, causing petitioner to park the vehicle due to safety concerns.
Called Justin to let him no he said he wasn’t willing to give any money back r taking any vehicle offered to fix the problem The primary issue involved the driveshaft and related transmission components, creating dangerous driving conditions and rendering the vehicle unreliable.
Defendant stated that if anything went wrong with the vehicle, repairs would be handled or corrected; however, defendant failed and refused to repair the vehicle after repeated issues arose.
Since purchasing the vehicle, petitioner has been forced to pay substantial out-of-pocket repair expenses, including but not limited to:
Driveshaft repairs;
Transmission-related repairs;
Thermostat replacement;
Alternator replacement;
Spark plugs;
Brake rotors;
Brake repairs;
fan;Additional mechanical repairs and maintenance costs.
Petitioner relied upon defendant’s statements and representations when purchasing the vehicle.
Had petitioner known the true condition of the vehicle, petitioner would not have purchased it or would have paid substantially less.
As a direct result of defendant’s actions and misrepresentations, petitioner suffered financial damages, hardship, loss of transportation, emotional distress, inconvenience, and additional repair costs.
PRAYER FOR RELIEF
WHEREFORE, petitioner, Chanelle S. Tippy, respectfully prays that:
Defendant, Justin Nathan, be cited and served;
Judgment be rendered in favor of petitioner and against defendant for:
All repair costs paid out of pocket;
Reimbursement of vehicle-related expenses;
Court costs and filing fees;
Any additional damages deemed just and proper by this Court.
