The Issue
Subject: Formal Request for Removal of Chain-Link Fencing at Bowsprit Dr. Bayville, NJ Terminus
Statement of Purpose: We, the undersigned residents, demand the immediate removal of the chain-link fence recently installed at the end of Bowsprit Dr. This structure is an unnecessary eyesore that was not present for decades and now poses a documented safety and environmental risk.
Reasons for Removal:
Flood Hazard (N.J.A.C. 7:13 Compliance): Chain-link fencing is unsuitable for a waterfront flood zone. In the event of a storm surge, the mesh will catch debris, obstructing the natural flow of water and increasing the risk of flood damage to adjacent properties.
Safety Liability: The fence is currently in a state of disrepair. As a "street end" structure, it serves as a hazard rather than a safety feature, potentially trapping debris or failing during high-velocity water events.
Violation of Public Trust: This fence creates a visual and psychological barrier to the [Name of Waterway], infringing upon the public's right to unhindered visual access to New Jersey’s tidal waters.
Lack of Necessity: For the majority of this development's history, no fence was required or present. Its recent installation serves no clear public benefit and detracts from the community's character.
Requested Action: We request that Berkeley Township remove this chain-link fence entirely within 30 days. If the town believes a barrier is legally required for vehicle safety, we request the use of low-profile bollards or nautical pilings that comply with DEP standards and do not catch debris or block the view.
