"The Dips" is a short path along a private road known as Happy Valley Glen Road, which crosses a creek and connects Glen Road and Happy Valley Road. The Dips has been open and in use by the community since at least 1944, and is a safe way for children to move between neighborhoods and walk/bike to Happy Valley Elementary. The Dips also offers an additional emergency escape route when Glen Rd is blocked, as was the case earlier this fire season.

The Dips is now being threatened by a homeowner lawsuit seeking rights to restrict neighborhood access and close the pathway.

The community asks for your support in signing this petition stating that:

(1) I wholeheartedly support keeping The Dips open and unimpeded, for continued pedestrian use; (2) the Lafayette City Council should not sign any Settlement Agreement - or take any other action -  that has the potential to negatively affect keeping The Dips open, and (3) the City's Condition of Approval S3, which was attached to the 2000 subdivision of the lots, requires that the 'private easement (The Dips) remain open for pedestrian use.'  The 1957 Deed for the same road says: 'The grantee, by the acceptance of this deed, agrees that he will reconstruct the road upon said real property and that said road shall at all times be kept open.'  These conditions should, at minimum, be interpreted and upheld as “use restrictions" requiring the property Owner to keep The Dips open and unimpeded.
