Grant Commutation to Jadarius Foster: A Call for Justice and Second Chances

The Issue

To Tennessee Board of Parole, Governor of Tennessee, and Concerned Citizens:

We are calling upon the Board of Parole and all concerned citizens to support the commutation of Jadarius Foster's sentence. Jadarius, a young father with a promising future, has been serving time for a situation that unfolded in a manner far beyond his control. Despite not being the aggressor in the incident that led to his incarceration, Jadarius accepted a plea under the immense pressure of facing potentially harsher charges. This petition seeks to highlight the disproportionality of Jadarius’ sentence to his actions and the significant personal growth and rehabilitation he has demonstrated since.

 

Background:

Jadarius Foster found himself at the wrong place at the wrong time, embroiled in a tragic sequence of events that would drastically alter the course of his life. While he was in a vehicle with his cousin, they were attacked by individuals in another car, leading to a dangerous exchange of gunfire. Jadarius, however, did not participate in the shooting. Acting in what was perceived as self-defense, his cousin returned fire. Regrettably, this encounter resulted in a fatality.

Faced with a daunting legal battle and under the threat of being charged with murder, Jadarius felt compelled to enter a guilty plea, despite his non-participation in the violence. This plea was not an admission of guilt for the act of shooting but a strategic move to avoid a potentially more severe punishment for a crime he did not commit.

 

Why This Matters:

Jadarius Foster's case is a poignant example of the complexities within our justice system, particularly regarding young African American men. His sentence does not reflect his direct actions but rather the tragic circumstances he found himself in. While in prison, Jadarius has shown exemplary behavior, pursued education, and participated in programs aimed at personal and parental improvement. He has demonstrated remorse, a commitment to change, and a sincere desire to contribute positively to society and his family.

 

Our Request:

We urge the Board of Parole to grant commutation to Jadarius Foster, considering:

  • His non-participation in the act of violence.
  • The immense personal growth and rehabilitation efforts he has demonstrated while incarcerated.
  • The strong support system and plans he has in place for a positive reintegration into society.
  • The disproportionate nature of his sentencing based on the circumstances of his case.
