Grant a New Trial for Dallas Robinson

The Issue

Dallas Robinson has been incarcerated since October 1st, 2014. He was only 18 years old at the time he was arrested and charged with party to a crime - felony murder in the state of Wisconsin. He is now 27, turning 28 next month. Dallas has spent over 9 years in prison, that is almost a decade now. He was sentenced to 18 years of incarceration and 10 years supervised release for a crime he did not commit.

Dallas was charged, along with 4 other co defendants in connection with the shooting, including 1 who was found NOT guilty of the charges party to a crime of felony murder, at trial - (see information here) 

Dallas was offered a plea deal and would have been home already if he plead guilty to the crime, but instead he stood tall on his innocence and was found guilty at a jury trial based on the fact that he placed himself at the scene of the crime and inconsistent and unreliable claims from others that he knew about a gun. 

There was unreliable eyewitness testimony, as well as inconsistencies in witness testimony during his trial. New evidence was brought forth after the trial. On September 14th, 2018, during a post-conviction hearing the shooter testified to the courts that nobody in the car knew that he had a gun (including Dallas) and that he (the shooter)  had no plans to even attempt to rob the victim, it just happened last second. A credible witness who could have provided testimony to Dallas’ case, was never called to court to testify. This is crucial evidence from the shooter that states Dallas had no knowledge that he had a gun, therefore this proves Dallas's innocence and should have been grounds for a new trial given new evidence provided. The Wi court of appeals denied Dallas’ request for a new trial on January 18th, 2023.

This has painfully affected Dallas and his family. This ripped him from all of his adulthood and tore apart 6 different families including the victim and HE deserves justice but this isn’t that. Dallas was a child, forced to be a man, forced to grow up within the prison system. Most studies show that the human brain doesn’t stop developing until age 25, important developments within the prefrontal cortex and other regions still take place well into one's 20s.. Dallas used to live with his parents his whole life, he was 18, working a job, looking forward to his future as an young adult and within a matter of an hour he was ripped away from everything, placed in prison fighting for his life and has been for the past 9+ years, he has lost faith in the justice system and ultimately lost hope in life. His case wasn’t fully tried based on new significant evidence.

For a felony murder party to a crime you need to Prove beyond a reasonable doubt that he knew there was a gun, AND that gun was going to be used in the commission of a crime. Dallas was convicted solely based on the fact that he placed himself at the scene willingly. There was no evidence to show that he knew either of those things or that anything was going to happen. The case is based solely on circumstantial evidence and the shooter's statement debunks all of that. In no way are we trying to say there wasn’t a crime that was committed and a life that was lost because there was but Dallas wasn’t the one who took a life, Dallas is innocent and now his life was taken from him for a crime that someone else committed.

From Dallas - “I am still serving 10 more years in prison for a crime I did not commit, I could be starting my life. but instead I'm locked in a cell, locked down all day and night. They stopped schooling as of right now, I'm 1 class away from getting my GED. This prison has been on lockdown for 6 months, no visits, no rehabilitation and no end of lockdown in sight. I am fearful when I do get out after serving 18 years, that I'm going to be behind on everything, not knowing where to start back up again because I will be 38 by the time I am able to be brought back into society. That is 18 years of my life that will have been taken away from me, 10 years already where I could have started my life, started a family, instead I am stuck locked away for a crime I did not commit. 28 years fully is what the system will be taking from me. I’m almost 28 years old right now.. I am considered a violent offender when not once since I have been in prison these 9 years have I gotten into a fight, or have been written up for any violent tickets. Imagine this be your brother, your son or someone you care about.. We are petitioning for a new trial and are trying to gain recognition and shine light on a case that is unjust.”
