For the Right to Live in Peace: Decriminalize Protest in Chile

To whom it may concern,

We, the undersigned, live in the U.S.A., and have become aware through the Human Rights Watch Report of November 2019, and through other international sources, of the serious human rights violations perpetrated against Chileans who protest against the current economic model and the political class that handles it.

 We are aware, therefore, that since October 18, 2019, at least 15,000 people have been detained; that close to 12,000 more have been injured; that around 2,000 people have suffered specific injuries caused by police anti-riot armament; that serious eye injuries caused by pellet guns have reached 350; that there are close to 30 deaths being investigated, some resulting from lootings and fires.  We also know of hundreds of legal cases in process for personal bodily injury and for harassment of a sexual nature. 

We have also become aware of the draconian legislation currently being debated in the Chilean Congress to criminalize the legal right to protest even further, as well as of the government’s proposal of constitutional changes that will allow it to keep the military forces on the streets permanently.

Our concerns for the safety of Chileans are shared internationally.  The world is watching, as we see the Chilean government acting outside the rule of Law and Chile sinking one more time towards tyranny and despotic treatment of its citizens. 

We demand:

• The immediate cessation of the usage of anti-riot armament by police and special forces; more specifically, the prohibition of the use of pellet guns, which have already caused irreparable damage to hundreds of Chileans.
• The decriminalization of protest.
• The assurance that the rights of workers to go on strike will be honored.
• The commitment to respect the rights of students to protest, and the assurance that harassment of students in their schools and homes will be immediately stopped.
• That all forms of repressive dissuasion will stop immediately.
• That the rights of the Chilean People to vote for a Constitutional Assembly and a new constitution will be promptly facilitated and not mired in delays and subterfuge.

Por el Derecho de Vivir en Paz: Descriminalizar la Protesta en Chile

Los y las firmantes vivimos en Estados Unidos y nos hemos enterado por informes internacionales varios, tales como el informe del Observatorio Internacional de Derechos Humanos emitido en noviembre de este año, de las serias violaciones a los derechos humanos perpetrados contra chilenas y chilenos que protestan contra el modelo económico y contra la clase política que lo administra.

Por lo tanto, estamos conscientes de que, desde el 18 de octubre del año en curso, se ha detenido a por lo menos 15,000 personas; que alrededor de 12 mil personas han sido heridas; que cerca de 2. 000 personas han sufrido daños físicos causados por armamento policial anti-motín; que daños oculares de gravedad, causados por balines y lacrimógenas, han alcanzado los 350 casos; que hay cerca de 30 muertes que se investigan, algunas como resultantes de saqueos e incendios. Estamos informados, también, de cientos de querellas legales por daños físicos y por aquellos resultantes de acosos de naturaleza sexual.

También nos hemos enterado de la draconiana legislación que se debate en este momento en el Congreso con el objetivo de criminalizar aún más el derecho legal a protestar, como también de la propuesta gubernamental para un cambio constitucional que le permita instalar a las FFAA permanentemente en la calle.

Nuestra preocupación por el bienestar del pueblo chileno es compartida internacionalmente. El mundo entero observa al gobierno chileno actuar fuera de la Ley y vemos, con preocupación, a Chile deslizarse una vez más hacia una tiranía y el trato despótico de sus ciudadanos.

Exigimos:

• El cese inmediato del uso de armamento policial anti-motín, más específicamente la prohibición del uso de balines que han causado daños irremediables a cientos de chilenos.
• La descriminalización de la protesta.
• La certeza de que el derecho de los trabajadores a la huelga será respetado.
• El compromiso a respetar los derechos de los estudiantes a protestar, y la seguridad de que la persecución de estudiantes en sus escuelas y hogares cesará inmediatamente.
• Que todas las formas represivas de disuasión cesarán inmediatamente.
• Que el derecho del pueblo chileno a votar por una Asamblea Constituyente y una nueva constitución se cursará a la brevedad, y no terminará anulándose en atrasos y subterfugios.
