The Issue

I demand the right to use our village green on Mistley Quay for whatever lawful event is planned for community benefit, including entertainment, music, singing, theatre, or any other performance art, and to pursue any lawful leisure or pastime interests, including the right to embark or disembark and tie up on the quay from any watercraft, without the risk of prosecution for criminal trespass. 


I understand that warnings made by TWLogistics, landowner of the Mistley Village Green, to the organisers of the Christmas Fayre on Mistley Quay, planned for December 14, 2024 led to the cancellation of the event after TWL advised those attending that they would be deemed guilty of trespass if they set foot on the village green.

Village greens are protected by the Commons Act 1876 and the Enclosure Act 1857.

They are areas of land where local people can enjoy lawful sports and pastimes, including fetes, picnics, and games. 

Mistley Quay has been the hub of the community, without restrictions, for over 300 years, with its  rich historical and cultural traditions. The unilateral decision by TWL to erect an unfit for purpose fence in 2008 deprived the community of its access to the water. Health and Safety Executive Inspectors are presently determining what instructions to issue TWL on a range of safety matters. Experts have been commissioned to determine whether their CCTV operations are compliant.

By signing this petition I demand that Essex County Council initiate immediate legal proceedings against TWL to oblige it to allow legitimate activities on the Mistley Quay Village Green and to order the removal of the not fit for purpose  fence that prevents users of the village green from use of the quay.
