Give parents back the POWER to parent!
The Issue
I am writing to all of you parents out there to express my deep concerns regarding the provisions of the Health Insurance Portability and Accountability Act (HIPAA) as it relates to the privacy of health care information for minors, particularly those under the age of 18. I believe that the current law, which grants minors the legal right to health information privacy starting at age 12, inadvertently limits the ability of parents and guardians to effectively care for and protect their children.
As a parent, I am facing a situation where I am unable to access critical health records for my child, who is still under my care and responsibility. While I understand the need for privacy, I also believe that parents should have access to their children's health information in order to properly guide and support them, especially during formative years when they may not yet have the maturity to fully manage their own health care needs.
Currently, I am in a position where I need health records for school, yet I am unable to obtain this information due to HIPAA restrictions. It seems contradictory that, under the law, a minor cannot even create an account or engage with certain services until the age of 13, but yet their health information can be withheld from parents starting at age 12. This creates unnecessary barriers for parents who are trying to make informed decisions for their children's well-being.
I strongly believe that changes need to be made to this aspect of HIPAA in order to strike a better balance between privacy and parental responsibility. At the very least, parents should have the right to be informed of any significant health matters, especially those related to sensitive issues such as sexual health, mental health, or the risk of sexually transmitted diseases (STDs). If a child wishes to request privacy from their parents after the age of 13, that request can certainly be considered, but parents should not be kept in the dark about matters that directly affect their child's health and safety.
I urge you to consider revising HIPAA to allow for greater parental access to health information, particularly in circumstances where the child's well-being and future are at stake. This change would ensure that parents are empowered to provide the guidance and care their children need during critical years, without unnecessary interference from government regulations.
