Issue Ews certificates to students belonging to RBA category in jammu and Kashmir.
The Issue
The 103rd amendment to the constitution of india, provides 10 percent reservation in jobs and admissions, at the central level to the students whose family income is below 8 lakh per annum , qualify other eligibility criteria and who don't fall under SC, ST or OBS category . They are to be identified as Economically weaker section (EWS) .
The j&k reservation act 2004, provides for declaring certain areas as socially and educationally backward, the residents of which are given a Resident of backward area (RBA) certificate. They are now given 10 percent reservation at the UT level . But the RBA category is not recognised at the central level, so they are not given any benefit of reservation in jobs under the central govt.
sro 518 issued in sept 2019, by the j&k govt brought a discriminatory amendment to the j&k reservation rules,2005, that held residents of backward area (RBA category) as ineligible for getting the EWS certificate.it is dicscriminatory because;
1. A resident of backward area who is having a BPL certificate can't take the benefit of 10 percent reservation for EWS category, where as the same person can get the benefit of EWS category if he Lives in a city of j&k.
2.All the residents of backward area irrespective of their income, whether they earn Rs. 1 lakh per annum or 1 crore per annum are treated as the same class.
The poor people of backward areas can't take the benefit of 10 percent reservation provided by the central govt to the EWS category as The RBA category has no benefit at the central level and they can't get the EWS certificate.
We request you to
1. Either abrogate the sro 518 so that the residents of backward areas whose annual family income is below Rs 8 lakh and also qualify other eligibility criteria as laid down by the central govt can take the benefit of 10 percent reservation for Economically weaker section.OR
2.the residents of backward area should be given option to cancel their RBAs to get the benefit oF EWS category.
