Get rid of Wyoming offset law for UIM coverage

The Issue

My husband was severely injured in a pedestrian accident. He was in the crosswalk, exiting a superstore when he was struck by a Jeep. The medical care he required exceeded $400,000 before our medical insurance. Shockingly, the driver who was at fault faced a mere $250 fine. Despite both the driver and us having Underinsured Motorist (UIM) coverage of $50,000 each, the Wyoming offset law meant that our coverage wouldn’t cover the expenses. Consequently, my husband still requires two more surgeries and continuous medical care. To make matters worse, attorneys took 40% of the compensation we received, leaving us in financial distress. Wyoming's current offset law for UIM coverage unfairly penalizes those like us who have diligently paid for protection, yet are left uncovered when calamities strike. UIM coverage exists to help where other insurances fall short, especially when dealing with substantial medical expenses from accidents caused by underinsured drivers. But under the offset law, benefits from our own insurance are reduced improperly, making it difficult to meet overwhelming medical bills and ongoing healthcare needs. It’s time for a change. Wyoming should align its laws to better protect residents in personal injury cases, ensuring that they can access the full benefits of their UIM coverage. States like Colorado and Montana have enacted laws allowing victims to fully utilize their UIM benefits, recognizing the crucial role these benefits play in recovery. By ending the offset practice in Wyoming and other states, we can ensure that accident victims truly get the coverage they deserve. It shouldn’t take a lawyer's intervention and excessive legal fees to obtain what's rightfully yours. Accidents invariably impose a heavy emotional toll, and their financial burden shouldn’t be compounded by inadequate laws. Please sign the petition to persuade the Wyoming State Legislature to reevaluate and abolish the offset law relating to UIM coverage, so future victims are not left to fend for themselves in times of severe need.
