To whom it may concern,

I am writing this petition to request the overturning of my DWUI case. I believe that the charges against me were unjust and unfair, and I am seeking justice for myself and others who have been wrongly accused. My whole life will be effected . Children job in house . i’m in jeopardy to lose those things.  All medical marijuana patients is driving around with a Dwui . 
is clearly up to the cop at the time of the detainment.  
Because marijuana is considered a schedule one narcotic
and the law states that you cannot drive on Pennsylvania roads with any sort of schedule, one narcotic in your system no matter the level

Firstly, the trooper had no reason to pull me over . I broke no traffic laws .
Unfortunately, my tag came up as a dead tag which means that it was in the process of being a transfer. But to be honest the  reason was that it was the pandemic COVID-19 hit and I didn’t have a chance cause everything was close to register the car. once the trooper pull me over, he said he smelt burnt marijuana .I told him I was not smoking,  but he still direct me out of the car to perform field sobriety tests .I would like to point out that the field sobriety tests conducted by the arresting officer were not administered correctly. According to a study published in the Journal of Forensic Sciences, these tests are only accurate about 65% of the time when administered properly. However, in my case, they were not administered properly at all. he also was not in full uniform, missing his microphone to record the audio of what was being said. I also must point out that the sun rays  made it hard for you to even see my foot movements do to the dark in blurry ness of the dash cam footage . I must say that he didn’t have on his body camera. With all that said, I don’t understand how it got to the point where he can even get my blood in the first place, I only consented to give them my blood because I was already under arrest for DUI 

And I wanted to prove that I was not driving under the influence. Not fully knowing the law I was a literate to the fact that just driving with marijuana in your system was a DWui no matter the levels 


Furthermore, I was not intoxicated. But because I agree to let the cop take my blood . it later reveal I did have marijuana  in my system from prior cannabis activity . Not that I recently smoke .the test do not test for levels . But only because it's in ya system make you guilty of a dui . Which is not fair to me or the 500000 medical marijuana, patience, and Pennsylvania . With know other reason but the fact he said he smell burnt pot . He then made me do all kind test to see if I was drunk.

of course he say I fail them . With no audio recording which is part of the cop uniform .Just word of mouth . I was found guilty of dui . 
for illegally driving on Pennsylvania rules with a schedule one narcotic in my system known as marijuana . No clue of when I last use . Now I have to go away for 90 days for something that . Clearly  legal for medical purposes .  I am medical patient but was not able to present the card at the time . No evidence was found in my car to confirm the smell of burnt marijuana, but somehow I still was subject to sobriety Test 

lWithout any concrete evidence proving that I was under the influence while driving, it is difficult to justify charging me with a DWUI.

if things continue to stay this way in the state of Pennsylvania, we all will be at Risk. There’s 500,000 medical marijuana patients at risk every day. We must fight to change this .  You can  buy  medical marijuana and then leave the dispensary. get pulled over from the local police and get charged with a DUI is almost entrapment.
Additionally, I would like to bring attention to the fact that many individuals who are charged with DWUIs are first-time offenders who have made an honest mistake. According to Mothers Against Drunk Driving (MADD), approximately one-third of all drivers arrested or convicted of drunk driving are first-time offenders.

it is time to change it now we’re in the process of decriminalized weed. We can’t find other ways to hurt people  by giving them DUIs that can be costly 

making it impossible to get a driving job   Or get to in from work . 
In conclusion, I urge you to consider overturning my DWUI case based on these facts and statistics. It is important that we hold law enforcement accountable for their actions and ensure that justice is served fairly for all individuals involved. In I’m waiting to be sentence as we talk . 

so if these things don’t change, there’s probably no reason to go get a medical marijuana card because you’re still riding around with a DWU in which we cannot afford as Pennsylvanians  so I ask that u stand with me or we will all fall together
