De'Marquise Elkins was charged and convicted of fatally killing a baby among other things. His trial was 2 weeks long and was moved because of the publicity of the trial. De'Marquise had an all-white jury who took only 2 hours to come back with a verdict. He was found guilty of ALL 11 counts he was charged for. He is now facing more time than Derek Chauvin, who is on video literally murdering George Floyd.

There were a number of concerns raised about the mother of the baby who was killed. West's daughter has even expressed her doubts about her mother's story. Defense attorneys argued police never investigated some statements.  Ashley Glassey, Sherry's daughter, said she grew suspicious of her mother when she called her the day of the shooting to ask how long it would take before her baby's insurer sent her a check. Two former wives of the baby's father, Louis Santiago, testified they contacted authorities with their suspicions about him but also never received a call back.

De'Marquise's background should not matter. We see this so many times with our black brothers and sisters. Their past is ripped up and their character gets torn to shreds. What should matter is whether he committed the crime or not and Mr. Elkins quite obviously did not get a fair trial. It is on the prosecution to prove that a crime was committed and there was very little evidence that pointed to Elkins. 

De'Marquise was 17 at the time and thus not eligible for the death penalty. in 2019, the Georgia Supreme Court ordered a trial judge to review whether he was properly sentenced to life without parole plus 125 years for a different crime, He has been in Macon State Prison in Georgia since 2013.
