“CORRUPTION AND ABUSE OF POWER”

THE SALE OF SILVER SADDLE RANCH

This Petition is going to be sent to California Governor Newsom to inform him of the corruption and abuse by Receiver, Thomas McNamara. Our goal as a community is to raise awareness of the abuse, but also to direct the Governors attention to the sale of Silver Saddle Ranch and Galileo Land by encouraging  the DBO to act on the best interest of the victims by considering elimination of the Receiver in this case. In the absence of the support of the governor and the on going corruption and abuse  the victim's will suffer irreparable financial, mental, and emotional abuse as articulated below.

We are seeking signatures in support of our plight because 3000 individuals had been wronged by the legal system.

INTRODUCTION: 

3000 individual victims, mostly elderlies and minorities, invested in the Galileo Project land in California City, CA, as an opportunity for their families and children to enjoy along with the Ranch and its many amenities. The victims collectively spent $54M in this opportunity. In addition, the victims were supposed to be able to acquire the Ranch property to use and enjoy with their families, however, this was denied to them. The Department of Business Oversight (DBO) alleged that the sale process was not done according to the Securities Exchange Commission guidelines for sale of fractionalized interests in land. Thomas Maney, owner of the Ranch and Galileo Project tried to correct the problem; but was denied by the DBO from doing so.

CORRUPTION AND ABUSE:

DBO’s mandate is supposed to protect the interests of consumers but instead, the DBO took the adversary position against the victims by not allowing them to speak about the unfairness. The victims requested to be heard but were denied. The DBO nominated the Receiver, Thomas McNamara into the case who was given unrestricted legal power to protect the assets belonging to the victims.   With this power, McNamara found a way to enrich himself by charging exorbitant amount of legal fees.  In order to be able to charge high Receiver fees, he confiscated the account that belonged to the victims in the amount of $897,423.  This bank account held the investors’ membership which they paid into as dues designed for the improvement of the Galileo Land.  So far, Thomas McNamara charged the victim’s account $376,550 for legal fees that did not benefit the victims and the case is not over. The balance in the account is now less than $200,000.  The Receiver Thomas McNamara is finding more ways to ensure that the source for his fees will continue to have money.  Now Thomas McNamara wants to sell the ranch and the Galileo land that belongs to the victims.  He is attempting to sell the Silver Saddle Ranch for $2.1 Million and plans to sell the Land for another $900,000.  This money, if the Receiver is allowed to sell the properties will become his source for his fees that will not benefit the victims.  The victims made known to the DBO and the Receiver Thomas McNamara that the properties should be given to the rightful owners and be protected for their benefit.    He continues to ignore the pleas of the victims like they do  not matter and fail to communicate properly with the victims and even rejected the victims request for a special meeting.  The victims hired an attorney to represent them however, McNamara threatened anyone who might want to bring information to the court about his atrocities.  He ordered the victim’s attorney to withdraw representation otherwise, he threatened to further seek attorneys’ fees for bringing into light his wrongfulness.   To engage in more malicious legal tactics McNamara made know to all that he can ask  Judge Joel Wohlfeil of the Supreme Court of California, San Diego to impose sanctions against the victim’s attorney and to whoever else that may attempt representing the victims. Further evidence of his corruption and abuse of power is demonstrated when seeking to sell the Ranch and the Galileo land, he accepted an offer from the lowest bidder, ignoring the highest offer from another buyer. The proposed sale of the property included the Galileo land which was titled to the victims and is being sold without the victim's consent. There is a high suspicion of collusion and unclean hands between the Broker and the Receiver in this transaction. The corruption is underlined by the Receiver's opposition to anything that can benefit the victims when a prominent investor proposed to Joint Venture with the victims to give them the opportunity to be compensated. The Receiver scoffed the idea that he would lose control of the properties which are his source of his newly found income source at the expense of the victims. Here we see that it is not about the victims but for his self enrichment.  

WHY YOU SHOULD SIGN THIS PETITION?

The first amendment of the United States of America states that we have freedom of speech. When our voices are suppressed in the self-interest of another, it is violated.  Our Judicial system serves to right the wrongs of corrupted individuals who hold power over others and ensure that those who were entrusted to carry the banner of Justice represents the main idea of equality under the law. These individuals who were appointed and voted into their positions or those who represent the institutions of the United State must be held to the highest of standards and are expected to be accountable when they violate the basic rights of citizens.  A system that fails to protect its people from corruption and abuse of power has no place in our society.  Based on the foregoing, we ask your support by signing our petition.
