The Menangle Park estate is an upcoming residential development located in Sydney's Southwest under development by Dahua Group. 'Stage 2B' of Menangle Park comprises approximately 90 future homesites and has been consistently met with delay after delay with little to no communication from the Developer.

We believe that Dahua Group is actively withholding critical information from land purchasers, and we, the Future Residents of Menangle Park are now demanding clarity after years of misinformation as we gear up for potentially, multiple years of delays.

Future residents have been forced to reach out via alternative channels in order to attempt to identify what is actually happening with their future homes, as any contact with Dahua Group or 'Menangle Park' results in either no information, constant hand-offs or conflicting information. A recent communication from the Developer has stated that the already extremely delayed Stage 2B is now indefinitely delayed until 'Late 2023' or beyond.

We, the undersigned, and future residents of Menangle Park, officially request a statement from the aforementioned parties regarding the recent updates from:

  1. Dahua Group Sydney Development Pty Ltd (DGSP), and;
  2. Urban Land & Housing (ULH), communicating as 'Menangle Park'.

An email was distributed to all land purchasers & solicitors in the affected areas on November 1, 2021 stating:

"Due to ecological issues associated with Stage 2B, Dahua Group Sydney Project 2 Pty Ltd (DGSP) has been unable to obtain development approval for Stage 2B . This means that there will be a delay in land registration for your lot affecting the sunset date set out in the contract."

"The issues currently raised by EES with respect to Stage 2B, are in relation to the development impacting sensitive vegetation. In order for development approval to be obtained, a thorough review considering recommendations by the EES is required, whereby DGSP will work closely with the EES to try to rectify these issues as quickly as possible."

"At this time, modifications to the subdivision layout are being considered by DGSP to address these items and DGSP is committed to working towards a resolution of these issues with a view ultimately being granted an approval."

This letter continues to state that DGSP is offering Stage 2B land purchasers a further extension of sunset to "Late 2023", or, rescission of contracts.

While some delays are unavoidable and expected, the consistent misinformation and lack of transparency are causing future residents extreme distress to the intentions of DGSP with the land market value rises seen through 2021.

Some of the expected registration dates for Stage 2B that has previously been communicated in writing by ULH on behalf of DGSP:

  • Q3 2020: ULH states in August 2020 that Stage 2B DA was granted, and construction has started
  • Q3 2020: ULH states that Stage 2B DA has been delayed, but is expected by September 2020
  • Q4 2020: ULH states that Stage 2B DA is expected by June 2021
  • Q4 2020: ULH states that Stage 2B DA is expected by August 2021
  • Q1 2021: ULH states that Stage 2B DA is expected by Q4 2021
  • Q1 2021: ULH states that Stage 2B DA is expected by May 2021
  • Q1 2021: ULH states that Stage 2B DA expected around Q2-Q3 2021
  • Q3 2021: ULH communicates on behalf of DGSP, that they are extending the registration sunset date to 31st October 2022 (Official communication)
  • Q4 2021: ULH communicates on behalf of DGSP, that they are offering a further extension of the registration sunset date to late 2023 or rescission of contracts. (Official communication)

ULH / DGSP offer no official communication channels for updates to Land Development for any residents of Menangle Park, with only 2 official communication updates (both being sunset extensions) having been provided since Late 2020. Communication from the above parties have and continue to be, extremely poor and unacceptable in regards to all development updates.

We as future residents have been forced to directly communicate with the Local Council, State Government and the Dept of Planning, Industry and Environment, among other third parties in order to gather any information around the Development Process as DGSP is unwilling to provide accurate information to Land Owners.

We also have second-hand information that ULH receives little to no information from DGSP in order to provide future residents with accurate information and updates. This has also been confirmed by employees of market-leading builders in NSW that have repeatedly stated that DGSP is non-communicative and, "one of the worst estates" they have worked with.

We are also aware that DGSP have been aware from the onset of the Estate, about the 'ecological issues' due to a compilation of:

  • Ecology Reports submitted by Dahua to Campbelltown City Council,
  • City Council Agenda minutes, and
  • Advice from independent contractors (A report of which was later documented in Sydney Morning Herald confirming that medium-density housing would be a key concern due to these issues)

Therefore, we also find it hard to believe how consistent delays are being communicated where no additional findings and/or concerns have been documented other than the initial ecological issue.

We request:

  1. Given that Stage 2B encompasses three independent packages of Land, strewn across the Estate. We request that Dahua Group communicate which explicit Lots and/or Regions are affected by the Concern, and to provide a formal explanation and describe explicitly the 'ecological issue'
  2. Dahua Group to advise residents of their planned pathway for unaffected Lots within Stage 2B, and whether a separate DA is under consideration in order to move forward with Lots that are not of Concern in an expedited manner.
  3. Dahua Group to advise the current modifications to the subdivision layout that are under consideration,
  4. A reasonable person would infer that Dahua Group is unwilling to concede to DPIE/EES to rectify the issues of Concern as it may affect high-value medium-density housing. We request that DGSP communicate that they are acting in the best interests of existing Stage 2B residents and demonstrate that they are actively complying with DPIE/EES regulations, and have made suitable adjustments per advice by DPIE/EES in previous submissions.
  5. Dahua Group to provide a formal explanation to the ongoing consistent delays of Stage 2B and a commitment to transparency and communication with the future residents of Stage 2B, and, Urban Land & Housing to ensure all current & future landowners are well informed of progress.
  6. Greg Warren, MP Member for Campbelltown to inquire on behalf of the future residents and families of Menangle Park and investigate if Dahua Group Sydney Development Pty Ltd is acting in the best interests of The Future Residents of Menangle Park or are delaying DA approval for Stage 2B in efforts to:
    1. Place pressure on the Dept of Planning, Industry and Environment by extending the approval process in order to minimize adjustments, by offering insufficient amendments and/or not adhering to guidance provided by DPIE/EES.
    2. Obfuscate or withhold critical information to residents in order to maximise contract rescissions.
    3. Unduly delay some or all of the approximately 90 Lots within Stage 2B that are unaffected by the Ecological Concern.
