The Issue
The 15 year old African American student was swimming with friends in Canton when he was confronted by a group of people. His older brother caught the entire incident on tape with his phone.
Says his mother, Tina Foley: "They started beating him up and holding him under water until he was pretty much not breathing."
Jordan Foley has a video of the Wellers calling his brother "The N word" as they attempted to drown him.
The Wellers are being charged with 'battery' and a 'hate crime'.
THIS IS NOT ENOUGH. This was not simply a 'hate crime'. This was attempted murder. This deserves more attention than a spot on the local news. These people must be tried for attempted murder.
"In order for a person to be guilty of attempted murder, that person should have deliberately, intentionally or recklessly with extreme disregard for human life, attempted to kill someone. There should be some substantial step towards committing the crime."
In Illinois Criminal Code defines attempt as follows:
§ 720 ILCS 5/8-4. Attempt
Sec. 8-4. Attempt. (a) Elements of the Offense. A person commits an attempt when, with intent to commit a specific offense, he does any act which constitutes a substantial step toward the commission of that offense.
I believe we can safely say that if this crime had been committed by a person of color, they would be charged with attempted murder without a second thought. This behavior is unacceptable and dangerous. The Wellers are unfit to live in a civil society. Demand that they be held accountable for the attempted murder of a young boy. Tell the Fulton County State Attorney to honor the Illinois Criminal Code and uphold the law NOW by putting them in prison, where they belong.
