Reinstate Officer Garrett Rolfe

The Issue

On June 12th 2020 Officer Garrett Rolfe with the Atlanta Police Department responded to a call at Wendy’s for a man passed out at the wheel in the drive through blocking traffic. Upon arrival Mr. Rolfe made contact with a man by the name of Rayshard Brooks. Mr. Rolfe woke Rayshard up and asked him to pull to the side of the drive through so that traffic could continue to flow. After moving to a parking space officer Rolfe and Mr. Brooks began chatting about why Mr. Brooks ended up in the drive through. Mr. Brooks stated he had drank a few alcoholic beverages a short time before and he had only had “one and a half margaritas”. While chatting with Mr. Brooks a second officer by the name of officer Devin Brosnan arrives and begins also speaking with Mr. Brooks.

Both officers begin a field sobriety test with Mr. Brooks to ensure he was alright to drive. Mr. Brooks fails this test and Officer Devin Brosnan requests Mr. Brooks take a PBT (Preliminary Breath Test) to determine the alcohol content of Mr. Brooks’ blood. Hesitantly Mr. Brooks initially refuses and says that he does not want to take it, but then changes his mind and agrees to Officer Brosnan’s request. Mr. Brooks then blows a .108BAC (legal limit to be driving is .08). The officers then determine that Mr. Brooks is not safe or sober enough to be driving at which point they attempt to place him into handcuffs. This is where it turns for the worst.

While placing him into handcuffs Mr. Brooks decides to begin resisting, jerking away from the officers and going to the ground on top of Officer Brosnan. Officer Rolfe begins wrestling with Mr. Brooks attempting to help Officer Brosnan in subduing Mr. Brooks. After a few seconds of fighting Officer Brosnan pulls his taser out and begins attempting to tase Mr. Brooks, at which point Mr. Brooks grabs Officer Brosnan’s taser and will not let it go. Officer Brosnan begins shouting “let go of my taser” several times. After a few more seconds Mr. Brooks is able to obtain Officer Brosnan’s taser and manages to get to his feet. Mr. Brooks then begins running toward the entrance to the Wendy’s drive through with the taser in his hand, at which point Officer Rolfe gets to his feet, draws his taser, and chases after Mr. Brooks. Mr. Brooks then turns and points the taser at Officer Rolfe and fires it, missing the officer. Officer Rolfe then pulls his service weapon and fires three rounds incapacitating Mr. Brooks. 

Medics were called to the scene and arrived six minutes after the call. Mr. Brooks would arrive to the hospital eight minutes after being shot and would eventually die in surgery. The next day the Atlanta Police Department Police Cheif Erika Shields resigned and Officer Garrett Rolfe was fired. 

Now the District Attorney’s office wants to bring charges against Officer Garrett Rolfe for multiple things including murder. The District Attorney Paul Howard who wants to press charges against Mr. Rolfe ruled that a taser is a deadly weapon not even two weeks earlier due to officers in the Atlanta area tasing a few college students in a vehicle. According to Atlanta law a deadly weapon, sometimes dangerous weapon or lethal weapon, is an item that can inflict mortal or great bodily harm. Furthermore, the same District Attorney then said in a statement to CBS “tasers are not lethal weapons, they are non-lethal.” Doesn’t make sense does it? Which is it, is it lethal or not? Due to the incompetence of this District Attorney and the justification of the shooting no charges should be brought against either officer involved.

 In short, this petition is here so that the Atlanta Mayor and District Attorney can see that these officers not only were justified in their shooting of Mr. Rayshard Brooks but also should not have lost their jobs so hastily. I firmly believe Officer Rolfe was fired due to the spineless fear from the Mayor of Atlanta wanting to be seen as “heroic” firing the officer who followed all protocol. Everything Officer Rolfe did was Standard Operating Procedure and he should still have a job to this day. Thank you.
