Fresh Student Living should surrender student's contracts due to COVID-19 implications
The Issue
UK universities have themselves started to publish statements releasing students from their obligation to pay the 3rd term. Fresh Student Living has not and is expecting students to pay their final payment in full.
A high premium is charged for facilities which are now closed. Our rent also includes all bills - services we will not be using that will undoubtedly result in reduced costs for providers.
Fresh Student Living has suggested that students engage in Tenancy Takeovers. How is this possible at a time when government advice advises against leaving your home? It is not feasible or safe to have tenants moving into flats at this time.
This is neither the fault of Fresh Student Living or ourselves as tenants, and has occurred after the commencement of our tenancies. Moving back into Fresh Student Living Buildings is a potentially serious danger to the health of students. Neither parties could have comprehended a situation like this prior to the signing of the tenancy agreement.
COVID-19 has been listed as a notifiable disease, meaning landlords are covered for disruption to business that occurs as a result of its related consequences. In addition this, private tenants have been given three month 'mortgage holidays'. While we appreciate and understand that we have entered a legal contract, these are unprecedented times which have called for measures, that were two weeks ago unimaginable, across every sector of our society.
We urge Fresh Student Living to release students from their tenancy agreements. Protect the mental health of students unable to work. Allow them to source safer accommodation to self-isolate if their families are key workers. And, most importantly help them to Stay Home and Save Lives.
