FREE WRONGFULLY CONVICTED TERRY DARNELL

The Issue

On March 17th, 2010 in a Tulsa County courthouse Terry Darnell was found guilty of 2 counts of robbery w/ firearm, burglary 1st degree, possession of firearm, and larceny of motor vehicle. He was wrongfully and harshly sentenced to life in prison plus 109 years. He has been incarcerated for the last 17 years and has maintained his innocence this whole time. On December 12th, 2008 there was a burglary at a home occupied by an older gentleman, 81-year-old Donald Payne. Mr. Payne made a statement before he passed away due to natural causes and was not present for the trial but his statement was used. In the statement used in court Mr. Payne stated that two negro boys came into his home. He also stated one was around 6 ft. and the other was around 5’6 ft. He said that he could not give the age of the perpetrators. When the court asked Mr. Payne if Terry was the one that held him at gunpoint his reply was yes, I think it is! Thinking rather than knowing for sure is two different things and that testimony shouldn’t have been used against Mr. Darnell. Mr. Payne was an older gentleman dealing with obvious health issues and after a traumatic event was not thinking properly. On the same day of Mr. Payne’s burglary another call was made to police about another burglary. The home of two teenage brothers Gil Robledo jr and Leobardo Robledo had been robbed. Both of these brothers picked out three different people out of a line up before they both finally picked Terry. The only other “evidence” besides the 3 eyewitnesses was a supposed partial fingerprint that belonged to Terry. This fingerprint was found on a jewelry box found in Mr. Payne’s bedroom. This evidence was used in court even though Mr. Payne stated that Terry was the one that held the gun on him while the other perpetrator stole items from the house. Mr. Darnell’s court appointed lawyer Brian Rayl never got another finger print expert to look at this evidence. Mr. Darnell was never caught at the scene of either crime. He was never found with any stolen property, never found in the stolen vehicle nor was his finger prints. Also, his family was never able to testify to give insight into his alibi. Julie Doss the assistant D.A in Tulsa county at the time begged an 11/12 white jury to take this man's life away and that’s exactly what they did. They convicted this man due to his past. In a Tulsa World article right after the sentence was given Julie Doss, Sgt Dave Walker, and a robbery detective stated Mr. Darnell was given such a harsh sentence to make an example out of him. To detour other young criminals from making the same mistake since the crime rate in Tulsa had been rising. This is just another example of how Tulsa County wants to convict rather than solve. Mr. Darnell was the only one ever convicted of these crimes. Seventeen years is a long time to be locked up for something you didn’t do. Especially with the deplorable conditions and extreme lockdowns at Lawton Correctional Facility. This man has 3 children and a new grandbaby that he wants nothing more than to get home to and be a productive member of society. Please help this man get back to his family and help him right the wrongs of the Tulsa County District Attorney's office. Please sign and share!
