
There was only one person who saw the robbery and killing of the late Mr. John Young Su Kang. This man worked with Mr. Kang and according to him (via statement) he closed the store with Mr. Kang on that fatal night and saw clearly who robbed, shot and murdered Mr. Kang. This statement was and remains clear with no room interpretation. The only eyewitness account unequivocally makes plain, that I was not involved, I was not at the scene and that I absolutely did not kill Mr. Kang. In Hollywood just this account alone is enough to liberate the wrongfully accused. In Hollywood, the articulation of such compelling evidence is the beginning of the end of the movie. In Hollywood, those in positions of power once it is clear that an injustice has taken place, they spring into action. Reality is much more real than Hollywood. The Innocence Project found this eyewitness in 2017. At the time, all that are within my circumference believed absolutely that I was on my way home. Some even started making preparations. I too believed that this piece of evidence was the key to clearing my name and securing my freedom. It took the court two years from the time that the witness provided this exculpatory statement to have a hearing to hear from said witness. Two years! The courts intentionally delayed a hearing that was about proof of actual innocence for two years! Why would that evidence not be prioritized? Why would freeing someone wrongfully convicted not be paramount? As a result of the outrageous and intentional delay, once the hearing was held two years later, the witnessed could not be found. My attorney argued that the statement should be able to stand on its own merits. The Court (one Judge) disagreed and gave me, an incarcerated man 30 days to locate a man that they could not locate, from state prison. I interrupted the proceedings and spoke directly to the judge. I stated, I am aware that your job is to seek justice for the victim in this case the late Mr. Kang. to be continued...
