Why this petition matters

Paul Davis has been languishing in a Michigan prison for 17 years, since being convicted of homicide in 2004. There is no physical evidence linking Paul to the crime. During pretrial procedures Paul participated in a line up without his attorney present and was not identified as the perpetrator who committed the crime. The prosecutor's entire case was elicited inconsistent statement's/ testimony from juvenile witnesses.
On April 26, 2017, Denise Henry authored a notarized statement and correspondence stating that she and her children were coerced and pressured by authorities to provide false statements and testimonies against Paul. In her letter she apologized for helping the Detroit Police convict a innocent man and stated she only did because officer Jones and Staples threatened to have Child Protective Services take her children.
Several police officer's involved in the case have been found to be corrupt. In 2015, a lawsuit accused detective LaNesha Jones in a botched 2006 homicide investigation. Ms. Jones and other officers mishandled the investigation and withheld information from prosecutor's that could have cleared Elroy Jones. The lawsuit was later settled.
In 2016 Ballistic Expert David Pauch was accused of falsifying and/or tampering with evidence in the case of Mr. Desmond Ricks. Mr.Ricks was exonerated of all charges and thereafter filed a lawsuit against Pauch and the Detroit Police Department.
Of extreme concern in this matter is the finding of the record/file being entirely void of any valid warrant, autopsy photos, pictures of victim, clothing's, blood samples, shell casings,forensic interview video footage, and other investigatory evidence which would customarily be found in a homicide investigation file and prosecution. These inconsistencies raises further concerns regarding the legitimacy and credibility of investigations involved.
Additionally, Paul's attorney failed to make attempts to locate two witnesses Jennifer and Tiffany who would've have corroborated alibi witness Tamika Holmes testimony as to the whereabouts of Paul during the time of the crime. He also failed to allow Tamika's brother Tommy Holmes take the stand. Tommy Holmes testimony would have clearly established that Paul was not the perpetrator of the crime. The prosecution was fully aware as well. Yet, failed to act. The new impeachment evidence, considered together with the full record of this case, creates a reasonable probability of a different outcome upon retrial.
All of the inconsistency and errors in Paul's case clearly establishes a compromise in the integrity of the judicial process. The federal Courts have acknowledged that when a agent has been found corrupt all of his or her case should be reexamined and or reversed where such act compromises the integrity of judicial process. Michigan is refusing to adopt such rule in most cases.
Paul was given a life sentence. He was just 22 years old when he was convicted. He's now 40 years old, and is still forced to beg the Parole Board, Court System and Prosecutor's Office to reexamine the evidence. Despite this , he says he believes in the system and has hope that he will one day receive Justice.
Society is becoming aware that wrongful convictions do exist and occurs more often than most people realizes. The reality is that most lawyers have heavy caseloads which causes them to push cases through the system. Police and prosecutor's , like all human beings make mistakes (errors). However, when a mistake is made our state government feels it has no duty to provide redress in most cases--even when their errors cost citizens their freedom and lives.
Fighting for Paul's freedom can be a step toward true Justice for all people no matter color, race, gender,class, or creed. Please take a moment to look at the attached documents which will give you a good sense of the staggering amount of evidence supporting his innocence. Then, please sign this petition calling on Governor Gretchen Whitmore, and Chief Prosecutor Kim L. Worthy of the Wayne County Prosecutor's Office/ Integrity Unit to grant Paul Davis post-conviction relief.
