In Florida, HOA's are governed by Chapter 720 of the Florida State Statutes, although there is no agency that enforces the Florida HOA statutes, the Department of Business and Professional Regulation (DBPR) deals strictly with association recalls or election disputes.  DBPR does not currently have statutory authority to investigate complaints against homeowners’ associations.  Furthermore, DBPR does not currently assist homeowners with mediation disputes against a homeowner association.  The legislature amended section 720.311 of the Florida State Statutes transferring this duty to private mediators.

Some of the issues identified by a group of concern homeowners include but are not limited to:

·       Board members staying in power indefinitely, there are associations where members are staying for over 20 years

·       Conflict of Interest

·       Mismanagement of funds

·       Community Safety Issues

·       Favoritism

·       Association recall is not practical and it can be complicated and very costly for homeowners, etc.

Proposal to Amend legislation

o  Two or three non-consecutive years max periods for all HOA board directors - that way they will not be able to move into the "Comfort Zone“ and a short term will give other motivated homeowners the opportunity to serve without having to wait a long time.

o  For owners with more than 5 properties, their vote should count up to 5 times max

o   To entice participation to become board director an incentive can be included for instance a $25 monthly discount from their HOA fees or  

o   If above does not work, then a vote from the homeowners should decide to name one Board Director or Ombudsman to enforce hiring an external Property Management Company who will be running the said community.

o   Decrease board member quorums from 7 to 4 or 5 depending on the size of community – in case of a recall the more directors involved the higher the cost to initiate a recall.  In which case will be more cost effective and will streamline the process. 

o  External Auditings to address issues of mismanagement of funds

o   Give statutory authority to DBPR as the designated agency to address complaints of conflict of interest, mismanagement of funds, Community Safety Issues, Favoritism, etc.
