Justice for Liam Smith
The Issue
On Sunday, 08/04/2019, at approximately 7:30 a.m. Liam Smith (3 years old) and his little sister (17 months old) were left alone in the living room while their father went to a back bedroom, made a conscious decision to put on a CPAP to ensure a comfortable sleep, and went back to bed. This act, he later admitted, he had done frequently while his wife was at work.
During this time Liam and his sister found their way into the laundry room, where they were trapped, and somehow Liam wound up in the washing machine. Three hours later when their father awoke he found the baby asleep on the floor, and eventually found Liam trapped without oxygen and unresponsive. He was later pronounced dead at the hospital.
The Department of Children and Families did an investigation which found two verified counts regarding the safety of these children in their father’s care. No charges were filed despite the fact that Liam’s mom asked the Orlando Police Department to further investigate on multiple occasions. She also met with a Deputy Chief and an Assistant State Attorney, all to no avail.
Under Florida State Law Statute 827.03 child neglect is
1. A caregiver’s failure or omission to provide a child with the care, supervision, and services necessary to maintain the child’s physical and mental health, including, but not limited to, food, nutrition, clothing, shelter, supervision, medicine, and medical services that a prudent person would consider essential for the well-being of the child.
In the state of Florida Child Neglect is a felony.
Please join me in asking State Attorney Ashley Moody to file child neglect charges to help us get justice for Liam. A little boy whose life mattered.
