The Issue

PTSD WARNING: Read and Watch At Your Own Risk

Spc Joshua A Pruitt Served during Operation Enduring Freedom Afghanistan 2005, and was inspired to create this petition after the loss of his brother PFC Gregory M Pruitt to Suicide in 2018, He served in South Korea.

Spc Joshua A Pruitt experienced infractions that shouldn't have happened along with his platoon in Afghanistan.

Veterans Nation Wide continue to suffer with PTSD and cannot receive VA Benefits due to bad paper discharges and or due to a negative discharge status that the Veteran should have not received in the first place because of their PTSD Diagnosis or they should have been medically boarded and Diagnosed with PTSD and it did not happen.

Donald Trumps White House Veteran Hotline is even failing.

Yale Law School filed a class action law suit for Veterans Nation Wide but this lawsuit only includes Veterans with Bad Paper Discharges, Other Than Honorable Discharge, what about the Veterans with Bad Conduct Discharges that did not deserve these discharges due to PTSD???

There are Veterans that have applied to these boards and have been illegally denied help.

I am bringing awareness today in regards to these denials and when the Veteran is denied three times the Veteran is now left with bringing the case to The United States Supreme Court.

As the highest judicial authority in the country, the Supreme Court serves as another avenue for appealing a court-martial conviction. If all other options within the military justice system have been exhausted and there are grounds for believing that constitutional rights have been violated or significant legal errors have occurred, you may petition the Supreme Court to review your case. 

There are no Veteran Organizations that will do this for the Veteran, I repeat, there are no Veteran Organizations that are going to take a case to The United States Supreme Court, the burden is left on the Veteran.

It is time to take a stand for Veterans who have the option of going before the boards to have a legal positive outcome along with Veterans who were denied by the boards to receive support going to The United States Supreme Court.

This is a horrible horrific nightmare daily on the Veteran. Veteran Service Organizations and Organizations just look at the Veterans DD214 and that is it and these organizations turn you away.

Let's notify the DOD and other Government Agencies that are suppose to be on top of these Veteran Organizations in regards to getting Veterans proper legal action.

ONLY 2 Cases out of the 1% to the U.S. Supreme Court is NOT Good:
The Supreme Court receives requests to hear nearly 8,000 cases every year. And each year, they choose roughly 80 of those cases to adjudicate. That’s a 1 percent acceptance rate. As of December 10, 2018, the Supreme Court will take on two cases related to veterans’ benefits in 2019.

The Board for Correction of Military Records (BCMR), The Army Review Board Agency (ABRA) and The Army Discharge Review Board (ADRB) is the last place in the Army you can go to change your record, including overturning a discharge that left you without medical benefits for service-related injuries. Its stated mission is to “correct errors” or “remove injustices.” Rarely does it do the latter, say vets and lawyers.

This Petition Calls For:
Department of Defense (DoD) can propose changes to the Uniform Code of Military Justice (UCMJ).
Congress creates the UCMJ, which is a chapter of the United States Code.
The President issues the MCM as an Executive Order. The MCM contains the penalties for breaking the laws in the UCMJ.
The DoD reviews the MCM and proposes changes to the UCMJ and MCM.
The DoD works with Congress to consider the recommendations.
Congress can make amendments to the UCMJ through legislation.

1) Advocate for changes to the Department of Veteran Affairs, the Board for Correction of Military Records (BCMR) the Army Discharge Review Boards (ADRB), the Army Review Board Agency (ARBA) to ensure that veterans are not illegally denied benefits and proper mental health support.
2) Challenge the legality of certain military practices, such as retaliatory actions against whistleblowers or violations of the Uniform Code of Military Justice.
3) Work to overturn policies that disproportionately impact veterans suffering from PTSD, such as bad paper discharges or negative discharge status.
4) Use legal expertise and public platforms to challenge the stigma around mental health and promote greater understanding and support for veterans.
5) Support class action lawsuits and other legal actions that seek to hold government agencies accountable for failing to provide proper support and benefits to veterans.
6) Fight Heinous Prosecution against Non-violent offenders.
7) Restructure and or Remove The Convening Authority's Power to multiple Leaders besides the Company Commander. (A convening authority (CA) is a military officer with the power to convene a court-martial and review evidence. They are granted these powers by the Uniform Code of Military Justice (UCMJ)).
8) Give Power to the Federal Courts to hear Military Cases.
9) Remove the 15 year UCMJ criteria under the "How to upgrade your discharge" and establish a open opportunity for Veterans.
