Stop the sale of "AS IS" cars in NC
The Issue
The state of North Carolina is still allowing the sale of "As Is" vehicles from dealerships with no provisions or protections for the consumer. This allows the average person to believe they are protected in some way by purchasing from a dealership when in fact they are just as protected as they would be if they were to buy a car off of Craigslist.
I am asking North Carolina to stand with states such as Hawaii, Massachusetts, Minnesota, New Jersey, New York, Rhode Island, and the Virgin Islands who have put in place used car lemon laws that provide minimum warranties despite “as is” sales and Arizona, Connecticut, Maine, and New Mexico also create statutory warranties or require the implied warranty of merchantability to be in effect for at least the first few weeks after the sale. Not to mention Pennsylvania, who provides that there is an implied representation that any vehicle sold in the state is roadworthy and Illinois and Nevada who have restrictions on disclaimers. Virginia, also requires special language in any disclaimer regarding a used vehicle sold for consumer use. At the very least Wisconsin even requires specific negotiation in motor vehicle sales to disclaim implied warranties. - Information taken from NCLC.org
The two most important purchases for most Americans is their vehicle and their home. Having reliable transportation is no longer a luxury but a necessity for most Americans to be able to provide for themselves. We need our government to reflect this idea for the protection of it's citizens and their financial health.
Used car lot's typically cater to individuals who are already under financial hardship and take advantage of desperate, unknowing and unsuspecting individuals.
It has also come to my attention that used car dealerships in North Carolina who have an on site repair shop are legally allowed to DO THEIR OWN INSPECTIONS. If that does not signal the allowance of fraud I don't know what does. Dealerships should have to have their car's inspected off site!
This petition was created out of my personal experience with Kelly and Kelly in Fayetteville NC. I was sold a vehicle and with in 2 weeks the Catalytic converter and the ECM have gone out. While the dealership did take care of the Catalytic Converter (which was like pulling teeth) they refused to do anything about the ECM that went out a week later. I strongly believe that no person who purchases a used car from a dealership should have to put the vehicle in the shop at their own expense before their first payment is even made! I can not sit by and watch this same scene play out over and over again on the review sites of used car lots!
Please sign this petition and stand with me against the sale of AS IS Cars by North Carolina Dealerships! We will be sending this petition out to local and state officials in an attempt to enact CHANGE!
