The Issue
Skilled but Unprotected: Skilled Worker Visa Holders Facing an Uncertain Future
Skilled workers came to the UK on the promise of a 5-year path to Indefinite Leave to Remain (ILR). Now, a sudden and unjust extension to 10 years is being forced upon them. This is not just a technical change; it’s a life-altering betrayal of trust.
We arrived under a government-endorsed, widely promoted, and revamped Skilled Worker Visa, followed the rules, paid our dues, and contributed to the UK, only to face the devastating prospect of those promises being pulled away.
We respectfully urge:

to urgently reconsider the retrospective impact of this policy shift.
What We Are Asking For:
- Honor the original 5-year ILR route for those already on it.
- Provide urgent clarity to stop anxiety from spreading through our communities.
- Uphold the commitment made to Skilled Worker Visa holders who moved here in good faith.
We are not seeking special treatment, only that the UK government uphold the principle of legitimate expectation, which it itself established.
We’ve Earned Our Place:
The Prime Minister’s immigration reform speech emphasized:
“Settlement in the UK is a privilege earned, not a right.”
“Only those who contribute significantly to our economy and society should stay permanently.”
We’ve done exactly that:
- Paying some of the highest taxes, often 40%+.
- Not relying on public funds for funding the NHS, schools, and roads.
- Working in roles that keep the UK running.
- Buying homes, building families, and investing what we earn in the UK.
- Paying tax on global income, despite not having ILR.
We came because the government wanted people during Brexit uncertainty. Now, we are forced to wait longer, reapply repeatedly, and live with ongoing uncertainty.
Families Are Already Paying the Price:
- Children may face international tuition fees and lose access to UK student loans.
- Rising costs and repeated visa renewals add stress and risk of job loss.
The CPS “Here to Stay” report, which underpins this policy, is based on a flawed premise: that migrants stop contributing after ILR. In reality, ILR allows higher-paid roles, greater tax contributions, and more community engagement. Many of us now fall into higher tax brackets, contributing beyond employment income.
Is this the message the UK wants to send? That loyalty, contribution, and trust mean nothing?
History Shows This Is Unfair:
- The 2006–2008 HSMP changes broke promises. The High Court ruled them unlawful, restoring fairness. It must happen again.
- Even the Post-Study Work Visa applied only to graduates after 2021. Fairness was observed then—why not now?
This Is About People, Not Policy:
We’ve done everything the UK asked. We’ve stayed. We’ve contributed. We’ve believed in the UK. Now, we are being punished for trusting the system.
Skilled workers pay high taxes, sustain essential sectors, and invest deeply in the UK’s future. Delaying ILR does not strengthen the immigration system; it fosters uncertainty and discourages long-term commitment.
It sends a dangerous message: that hard work, loyalty, and good faith count for nothing.
We do not oppose reasonable migration measures, but moving the goalposts after life-changing decisions is unfair. Stability and trust are essential, not just for migrants, but for the integrity of the UK immigration framework.
This is about trust, people, and doing what is right.
