Fair Go on E-Bike Laws: Speed Limits, Not Power Bans

The issue

Australia is currently witnessing an unprecedented crackdown on sustainable transport. Under the newly adopted EN15194 standards and "nation-leading" reforms introduced in March 2026, thousands of law-abiding citizens—commuters, retirees, and families—are being treated like criminals.

While we support safe streets, the current laws are retrospective, inconsistent, and fundamentally unfair.

Why This is Unfair and Excessive
1. The Double Standard: In Australia we regulate vehicle behavior, not just potential but;

Passenger Cars: A standard sedan can exceed 200km/h, yet we do not crush it in the driveway because it has the potential to speed. We fine the driver if they break the law.

Heavy Vehicles: Australian trucks are legislated to a 100km/h or 110km/h limit via speed limiters. They are permitted to have high-horsepower engines to manage loads and hills. If a limiter is tampered with, the vehicle is grounded for repair—not seized and destroyed.

E-bikes are the only transport class where both the motor size and the speed limit makes the vehicle "illegal," even if the rider never exceeds 25km/h.  This means the 1000s of e-bikes purchased in good faith have no chance of being modified to comply.

 2. The Denial of "Natural Justice" If a car is illegally modified, the owner receives a defect notice and the opportunity to return the vehicle to compliance. Under the new 2026 reforms, police have been granted powers to seize and destroy e-bikes on a first offense—even if they were purchased in good faith. Owners are being denied the "Right to Remediate" their own property.

3. Retrospective Penalties: Thousands of Australians purchased their e-bikes legally under previous or ambiguous frameworks. The sudden, rigid enforcement of the 250W limit—which ignores the ability to software-lock a bike to 25km/h—is an attack on private property and the cost of living.

Our Demands
We call on Federal Transport Minister Catherine King and State Transport Ministers to:

  1. Regulate Speed, Not Watts: Remove the arbitrary 250W motor capacity limit. Align e-bike laws with heavy vehicle laws by focusing on a 25km/h assisted speed limit.
  2. Establish a "Right to Remediate": End the "seize and destroy" policy. Provide a legal pathway for owners to install speed limiters or software locks to bring their existing bikes into compliance.
  3. Introduce a "Speed Pedelec" Class: Create a new registration category for e-bikes capable of up to 45km/h, providing a legal and regulated space for long-distance commuters.
  4. National Buy-Back Scheme: If the government refuses to allow remediation, it must provide adequate compensation for property rendered illegal by these retrospective changes.
