‘Meta INC - Facebook’ and ‘Samasource Kenya EPZ - Sama’- Obey Court Orders And Pay Us!
The Issue
We are a group of over 180 Facebook content moderators in Nairobi, Kenya. Our work is critical to the safe functioning of Facebook. ‘Facebook’ and Kenya based outsourcing company, ‘Sama’ recently sacked all of us in a sham redundancy. We quickly realized our jobs were not being cut, but that Facebook was simply switching providers from Sama to Majorel. When we tried to re-apply for our jobs at Majorel, we were shocked we’d been blacklisted from doing so.
That is why we have taken Facebook and Sama to court. Meanwhile as we wait for the case to be properly heard, the judge has ruled that Sama must continue to pay us our salaries. Despite the court orders, in April Sama chose not to pay us. We are now unable to pay rent, pay our bills and feed our families.
This petition demands that:
1. Facebook and Kenya based outsourcing company, Sama pay our withheld salaries immediately in compliance with the issued court order dated 21st March 2023.
2. That both the Attorney General (AG) and Office of the Director of Public Prosecutions (ODPP) through the Employment and Labour Relations court be seized of this matter as amicus curiae.
3. That the Ministry of Labour and Social Protection & The Central Organization of Trade Unions (COTU-K) compel both Facebook and Sama to acknowledge moderator's right to organize and to fight for better working conditions.
4. That the Ministry of Labour and Social Protection ensures that Facebook and Sama adhere to the court order preserving the immigration status of Facebook Content Moderators to remain in Kenya lawfully pending the hearing of the case.
