Subject: Extraordinary delayed HMDA villa gated community project, and maintenance issues due to builder’s negligence, intimidation and unavailability

Background: Westend Greens is a villa gated community project of 117 proposed villas constructed by Countryside Realtors India Pvt. Ltd., a Company registered under Companies Act, 1956, having its past known office at Plot No.3, Amar Housing Society, Kavuri Hills Phase II, Madhapur, Hyderabad-500033, represented by two of its First Directors: I) Mr. K. N Simha, S/o. K Suryanarayana, Aged about 53 years, R/o. #104, Armsburg Apartments, Jeedimetla, Hyderabad-500081. II) Mr. Masood Hasan, S/o Mohd. Hussain (Authorized signatory), Aged about 41 years, R/o. D-14/2, D.A.E. Colony, ECIL Post, Hyderabad- 500072.  The builder’s appointed representative is Mr. Saurabh Pandey.

 

The project is approved by HMDA on 03-Nov-2011 via L.P.No.1140/LO/ZO­SKP/HMDA/2011. At this point, approx. 20 villas are completed where families are residing, approx. 15 are under construction for past four years, approx. 20 are mortgaged to HMDA, approx. 20 are sold as villa plots with an unknown agreement to construct them in a stipulated time and using the same elevations as other villas, and few more with unknown status. 

 

In the last 12 years, the owners have been facing many challenges with the builder due to its unavailability, unresponsiveness, and intimidation. Recently the builder has stopped entry of maintenance and our personal help staff from entering the society. The core issue is that builder has not completed the basic amenities, does not have an office, does not have a bank account, does not communicate, uses its security to intimidate us, and not maintaining the society. 

 

Our demands to the builder:

1.      A written and signed declaration of “Handing over the maintenance and security to Owners group effective Jan 2024”. And a letter to all buyers and owners’ informing of the same and ask them to start paying monthly maintenance to owners’ group. For unfinished or non-handed-over or unsold villas/plots, the builder needs to collect and pay the maintenance on a monthly basis or in lump sum at the time of handover calculated from Jan 2024.

2.      A written and signed document on a company letterhead describing the date wise plan of the development of the common amenities working in a good condition, including STP, WTP, Pneumatic Pumps, Electric Panels, Underground Wiring, Drainage line including flood control, Solar fencing, Perimeter Fencing, Power backup, EB-DG Dual meters, Streetlights, Pavements, Playground, Club house, and obtain all occupancy related approvals.

3.      A dedicated on-site representative working full time in the regular business hours, with a working phone and email, who is responsible, accountable and has access to individual villa/plot accounts information to be able to resolve queries with ETA of 2 working days from owners who are eagerly waiting to get handover.

4.      The builder should stop harassing and intimidating the residents and their personal workers by deploying its security and bouncers.
