Subject: Petition regarding the lack of Metro Rail connectivity to North Hyderabad (Medchal and Surrounding Areas) and discriminatory approach in planning Metro Phase II expansion.

The humble petition of the Petitioners above-named:
1. Introduction:
1.1 The Petitioners, representing the residents of North Hyderabad, including Medchal and its surrounding areas, respectfully approach this Hon’ble Court under Article 226 of the Constitution of India, seeking the issuance of an appropriate writ, order, or direction to the Respondents in relation to the discriminatory approach adopted in the planning and execution of the Hyderabad Metro Rail Phase II expansion, which has excluded the North Corridor of Hyderabad despite the area being densely populated and having a critical need for public transportation.
2. Grievances of the Petitioners:
2.1 The North Corridor of Hyderabad, comprising areas such as Medchal, Suchitra, Jeedimetla, Kompally, and surrounding localities, houses thousands of residents who face daily challenges due to the absence of adequate public transport infrastructure, particularly Metro connectivity.
2.2 Despite repeated representations, peaceful demonstrations, and public demands by the residents and local civic organizations, the government has failed to prioritize Metro connectivity for this region, while making significant investments in other corridors that are either sparsely populated or slated for future development, such as the proposed Future City corridor.
2.3 The Petitioners highlight the severe traffic congestion, pollution, and transportation challenges in the North Corridor, which affect the quality of life and economic growth in this region. The absence of Metro connectivity severely hampers the daily commute of thousands of residents and disproportionately affects the working population, students, and the elderly.
3. Discrimination and Lack of Planning:
3.1 The Hyderabad Metro Rail Phase II Detailed Project Report (DPR) has included several corridors, including the Future City area, which is presently underdeveloped. However, the North Corridor, which is densely populated and has a pressing need for public transport solutions, has been blatantly excluded from the plan.
3.2 The planning and execution of Metro projects should consider areas that are currently facing acute transportation crises, and it is unjust and discriminatory for the Respondents to prioritize future development over the immediate and critical needs of existing communities.
3.3 The Petitioners submit that the Respondents have failed in their duty to ensure equitable distribution of public infrastructure projects and have violated the principles of equality, non-discrimination, and good governance enshrined in the Constitution of India.
4. Legal Grounds:
4.1 Violation of Article 14 of the Constitution of India: The Respondents have adopted a discriminatory approach by excluding the North Corridor from the Metro expansion plan, thereby denying the residents of this region equal access to public infrastructure and violating their right to equality before the law.
4.2 Violation of Article 21 of the Constitution of India: The lack of Metro connectivity in the North Corridor adversely affects the right to life and livelihood of the residents of this region, as they are forced to endure daily traffic congestion, long commute times, and deteriorating air quality, all of which impact their health and well-being.
4.3 Failure to ensure equitable urban development: The Respondents have neglected the principles of equitable urban planning by prioritizing future development areas over regions that are currently in need of urgent public transportation solutions.
5. Prayer:
In view of the above facts and circumstances, it is respectfully prayed that this Hon'ble Court may be pleased to:
a. Issue a writ, order, or direction to the Respondents to immediately reconsider and revise the Hyderabad Metro Rail Phase II project to include the North Corridor (Medchal and surrounding areas) as a priority.
b. Direct the Respondents to conduct an independent and impartial traffic and infrastructure study in the North Corridor to assess the urgent need for public transportation solutions, particularly Metro connectivity.
c. Direct the Respondents to ensure equitable distribution of public infrastructure projects across Hyderabad, with particular attention to areas that are currently underserved, such as the North Corridor.
d. Issue any other appropriate orders or directions as this Hon’ble Court may deem fit in the interests of justice and fairness.
6. Interim Relief:
Pending the final disposal of this Writ Petition, it is further prayed that this Hon'ble Court may be pleased to issue interim directions to the Respondents to halt further planning and execution of the Hyderabad Metro Rail Phase II project until the grievances of the residents of the North Corridor are addressed.
