Extend the Statute of Limitations for Medical Malpractice from 2 to 4 Years

The Issue

My son, Christopher Holden, was just 20 years old when he tragically lost his life at Emory University Hospital in Atlanta due to medical malpractice. He had a complicated heart condition and underwent surgery during the peak of the COVID-19 pandemic. The doctors were confused and unprepared, leading to my son's untimely death.

Christopher didn't have enough time for his antibiotics to work before they proceeded with a high-risk heart surgery. This led him into cardiac arrest due to a massive infection that was not properly addressed by the medical team. No parent should ever have to experience this kind of loss.

Medical malpractice is more common than we would like to believe. According to Johns Hopkins Medicine, it is the third leading cause of death in the United States after heart disease and cancer (Makary & Daniel, 2016). Yet victims and their families often face barriers when seeking justice due to restrictive laws on statutes of limitations.

Currently, victims only have two years from discovery or occurrence of harm caused by medical negligence or wrongful death in Georgia (O.C.G.A §9-3-71). This short window often leaves families scrambling for justice while still grieving their loss.

We are calling for an extension on this statute from two years up-to four years. This will provide families with adequate time needed for thorough investigations into their cases without being rushed by legal deadlines.
