

Expand Madlanga commission’s terms of reference
The Issue
Corruption has become one of the greatest threats to South Africa’s constitutional democracy, economic development, and social justice. Every year, billions of rand that should be invested in healthcare, education, housing, policing, infrastructure, water, electricity, social development, and job creation are diverted through fraud, bribery, procurement irregularities, state capture, and organized criminal networks operating within and alongside public institutions.
The consequences are devastating. Communities continue to experience failing municipalities, deteriorating roads, collapsing water and sanitation systems, prolonged electricity shortages, under-resourced hospitals and clinics, overcrowded schools, youth unemployment, rising poverty, and increasing inequality. While ordinary South Africans faithfully pay taxes and contribute to the country’s development, many public officials entrusted with safeguarding public funds have allegedly abused that trust for personal enrichment.
The Madlanga Commission represents an important opportunity to uncover the truth and restore public confidence. However, the current terms of reference are too limited to fully expose the scale, complexity, and interconnected nature of corruption affecting our nation. Restricting the Commission’s investigative scope risks leaving significant evidence unexplored and many individuals or networks beyond meaningful scrutiny.
We therefore call for the Commission’s mandate to be expanded to allow investigations into:
Allegations of corruption across all spheres of government, including national, provincial, municipal, and state-owned entities where relevant.
Procurement irregularities, tender manipulation, conflicts of interest, front companies, and unlawful enrichment.
Organized corruption involving both public officials and private entities where evidence suggests collusion.
Financial flows, asset concealment, and illicit enrichment linked to corruption.
Failures of oversight institutions that may have enabled corruption to continue unchecked.
Systemic weaknesses in governance, accountability, procurement systems, and public financial management that facilitate recurring corruption.
Furthermore, we request that the Commission be adequately resourced with the investigators, forensic auditors, legal experts, financial analysts, prosecutors, and technological support necessary to conduct thorough investigations without unnecessary delays.
We also urge that:
The Commission be empowered to refer evidence promptly to relevant law enforcement agencies for criminal investigation and prosecution where appropriate.
Robust protections be strengthened for whistleblowers who risk their livelihoods and personal safety in exposing corruption.
Public reporting be transparent so that citizens remain informed about the Commission’s progress and findings.
Recommendations made by the Commission be accompanied by clear implementation mechanisms to ensure accountability and prevent reports from gathering dust without meaningful action.
South Africa’s Constitution is founded upon accountability, responsiveness, openness, and the rule of law. Public office is a public trust, and those entrusted with managing public resources must be held to the highest ethical standards. Where corruption is allowed to flourish unchecked, constitutional rights—including the rights to dignity, healthcare, education, housing, security, and equality—are undermined.
An expanded Commission would not only identify wrongdoing but also recommend reforms to strengthen governance, improve procurement systems, enhance oversight, recover stolen public funds, and prevent future corruption. Recovering misappropriated resources would enable greater investment in essential public services, economic development, and opportunities for future generations.
This petition is not directed against any individual or political party. It is a call for transparency, accountability, justice, and good governance in the interest of every South African, regardless of political affiliation.
Our nation cannot afford to lose another generation to corruption. Every rand stolen is a school not built, a hospital not equipped, a road not repaired, a business opportunity lost, and a family left without hope.
We therefore respectfully call upon the Government to:
Extend the duration of the Madlanga Commission to allow sufficient time for comprehensive investigations.
Expand its terms of reference to investigate all credible allegations of corruption and systemic governance failures within the limits of the law.
Provide the Commission with sufficient funding, personnel, and investigative resources.
Strengthen protections for whistleblowers and witnesses.
Ensure that the Commission’s recommendations are implemented through effective oversight and, where appropriate, criminal and civil proceedings.
South Africans deserve institutions that serve the public interest with integrity, honesty, and accountability. By strengthening the Madlanga Commission, we take an important step toward restoring trust in our democracy, protecting public resources, and building a more just, transparent, and prosperous South Africa.
