The Issue
I am a permanently disabled individual, living below the poverty level in a community governed by a Homeowners Association (HOA). Each year, the dues increase while my Social Security income remains stagnant. This situation creates an undue hardship for me as it becomes increasingly impossible to meet my financial obligations.
I am unable to secure better employment or receive raises to accommodate these increases due to my disability. Moreover, I cannot fully utilize the facilities that these dues are supposed to maintain. The threat of legal action and potential homelessness looms if I fail to pay these escalating fees - a reality that is becoming increasingly likely given my circumstances.
Unfortunately, this is not just my story but reflects the experiences of many disabled individuals living in HOA communities across our nation. According to data from the U.S Census Bureau, approximately 12% of adults in America live with some form of disability and over 25% of those individuals live below the poverty line.
We call upon lawmakers and HOAs nationwide to consider implementing exemptions for disabled persons who are financially struggling due to fixed incomes that do not keep pace with rising HOA dues. This change would provide much-needed relief for vulnerable members within our communities who are at risk of losing their homes due solely on their inability to afford ever-increasing fees.
