Refund ExamSoft Fee to July 2014 Bar Exam Takers.

The Issue

July 2014 Bar Exam Takers demand ExamSoft Worldwide Inc. to immediately refund the license fee for failing to prepare and maintain the system while the bar takers were trying to upload the answer files.

This lack of competence cost exam takers emotional distress, lack of sleep, lack of productivity and possibly a failed bar exam.

This is unacceptable and ExamSoft has an ethical obligation to make this incident right.

There were deadlines for the exams to be uploaded and ExamSoft caused people to miss those deadlines, resulting in new, ad hoc deadlines made between ExamSoft and state bar examiners that were entirely beyond the scope of what was contemplated by those who bought the software. That’s not an inconvenience, that’s a failure. EXAMSOFT FAILED.

It appears that Examsoft’s servers had some problem dealing with the crush of bar applicants trying to upload their exams last night.  As Inside Higher Ed and Above the Law report, many bar applicants were unable to upload their exams on Tuesday evening or had significant upload difficulties.  Were that not bad enough in itself, the bar exam is delivered over multiple days, so even those who were able to upload their exams late into the night had to get up early this morning to take the next part of the exam.

Knotts said he couldn’t say what time the delays began or how many people in total were affected but said by late afternoon on the east coast, the company had noticed extended wait times on its support line. Knotts said the company is looking into what caused the delays and hopes to have an answer by later Wednesday morning. “What happened today is not acceptable,” he said.
