PETITION TO OBJECT - Application to use 7 Petunia Close, Verulam as a Mortuary
The Issue
ERF 561, 7 Petunia Close, Verulam has been Designed by the Property Owner & Approved by eThekwini Municipality to be used as Shops and Residential Units which can be located within the Suburb of Temple Valley, Verulam.
The Property Owner wishes to use this Development (Designed as Shops and Residential) as a Mortuary under Special Consent Application. This is against the law.
Should eThekwini Municipality grant the "Special Consent Application to use 7 Petunia Close, Verulam as a Mortuary" it will then Contravene the following South African National Acts :
- National Health Act, 2003 (Act No 61 of 2003)
- National Environmental Management Act 107 of 1998
- National Water Act 36 of 1998
- National Building Regulations and Building Standards Act (Act 103 of 1977)
- Engineering Profession Act No. 46 of 2000
- South African Law Reform Commission Act, 1973 (Act 19 of 1973)
Should eThekwini Municipality grant the "Special Consent Application to use 7 Petunia Close, Verulam as a Mortuary" it will then :
- Devalue the Surrounding Residential Properties. There is no citizen that will purchase property next to a Mortuary within a Residential Suburb.
- Promote a Negative Social Impact on the Temple Valley Community
- Promote a Negative Heritage Impact on the Temple Valley Community which currently has a Very High Sensitivity Heritage Impact and dates back to 1850.
- Promote a Negative Economic Impact on the Temple Valley Community.
- Promote a Stronger Presence of the Covid-19 Disease within the residential of Temple Valley, which currently is not the case.
- Promote the Environmental Contamination of 2No. Rivers which are 66m away equally from 7 Petunia Close.
Members of the Public are requested to view a Special Consent Application to use this proposed development as a Mortuary, (which the Development is NOT Designed for) at this link :
