Establish National Recognition of Electrician Licenses Across All States
The Issue
The challenges posed by the lack of national recognition for electrical skilled trade licenses.
Currently electricians licensed in one state are not recognized in all 50 states nor in outlying territories. This failure to recognize electrical licenses nationally creates a regulatory and licensing geofence that treads upon American electricians and theirs families constitutional rights at an alarming frequency.
NEC 90.4(A) is being weaponized as a regulatory faraday cage to imprison these skilled tradesman locally and creating polarity in our country.
States with reciprocal licensing programs are creating regulatory succession territories from USA and NEC/NFPA.
This unusual use of local policy affecting national level policy violates our 8th amendment. This situation not only has allowed states to oppress electricians rights under the constitution, it incorrectly allows states and local AHJ’s to induct their authority over local requirements at a national level, but it also limits electricians' pursuit of life, liberty and happiness - fundamental rights enshrined in our Constitution. State and local authorities having jurisdiction should be able to impose local requirements, but they should not induct these local regulations that are overarching of American electrician's rights under the constitution.
This limits our use of Amendment 14, Section 1, Clause 8.13.2 Interstate Travel as a Fundamental Right under our constitution.
The current system creates unnecessary isolation for any skilled professionals who wish to work across state lines. It hinders our ability to serve communities that may desperately need our skills and expertise. The parallel existence of conflicting regulations is just a series of failures to avoid conflicting regulations by code, policy, and law makers.
Therefore, we call on lawmakers at both federal and state levels to rectify this issue promptly by establishing national recognition for all licensed electricians across America. If a solution can’t be generated to get this rectified by lawmaker then federal courts have the capacitance to declare this unconstitutional under # 42 U.S. Code § 1983 - Civil action for deprivation of rights and transform the electrical licensing practices. Watt this would do is restore our constitutional rights and allow us to better serve the community.
State and local authorities having jurisdiction should be able to impose local requirements as they see fit but not to induct limitations on our ability to travel and work nationwide. This local imprisonment of electricians over steps states and local jurisdiction by not recognizing that we all work under the National Electrical Code and live in the USA.
