Approve Clemency for Spencer Bowens
The Issue
Spencer is now serving a life sentence for drug conspiracy. He has been incarcerated since 1998. The sentencing court designated Spencer as a career offender based on 2 prior convictions. Spencer has argued from day one that one of those convictions that arose from the early 1980's was actually dismissed, but the court used it anyway to enhance him. These are the only blemishes on his record. Spencer was plagued by the people that he trusted. While he takes responsibility for his actions, others that he associated with contributed to his life sentence. Co defendants of Spencer where under the same indictment but charged only with powered cocaine and received a much lower sentence and subsequently release. The court used standards that the U.S. Supreme Court have now ruled unconstitutional. Spencer has petitioned the court on numerous habeas petitions all to be denied on procedural grounds and not the merits of an unconstitutional sentence. In addition the U.S. Supreme Court, Congress and the U.S. Sentencing Commission have said that the crack cocaine sentences have been draconian and overstated. Numerous case law and sentencing amendments have been enacted, but none for career offenders or the ones that were sentence pre-Booker. It should also be noted that Spencer was never convicted of any violence nor associated with it. Spencer has an abundance of family that supports him with letters and visits. He has children that need him home. Over the last 16 years Spencer has been a model inmate. He has completed numerous self improvement courses, computer classes, parenting and he has taught classes as well. Spencer has letters from numerous Bureau of Prisons staff that have attested to his hard work and rehabilitation throughout the years. We, the family and friends are asking for you to sign this petition. 16 years in prison is long enough. His debt has been paid to society. Thank you.
