
Through the course of her practice as a registered mental health nurse, the Applicant was the subject of Fitness to Practice proceedings instituted by the Respondent in its capacity as the statutory regulator of nurses and midwives. The allegations concerned unrelated incidents in April 2017 and January 2018. Following a panel hearing between 6th to the 10th September 2021 and concluded on the 13th to the 14th September 2021. The Applicant was struck off the nursing register and is no longer permitted to practice.
Like a number of cases that have successfully appealed at the High Court before her, whilst she admitted to her failings, she denied any dishonesty and due to this denial, she was struck off the nursing register
The case of Karout V's NMC ( 2019 ) found the panel disregarded the acquittal in criminal court and yet still presented the same evidence at NMC hearing - the same has occurred in this case
In order to get her career back she needs to challenge the decision making of the NMC through the High Court
She is not in a union and so will have to fund this herself
NMCWatch are assisting with a team of volunteers, but there are still some costs associated with this and preparation for an appeal takes many hours of work. Sherry Ann will try to present the case herself as a litigant in person. Although initially able to work in a healthcare assistant role the stress has finally hit her and for the last couple of months she has been unable to work due to PTSD.
The court has agreed the appeal can proceed and a date set for the 29th July
The NMC have conceded that the appeal should be allowed but they wanted it to return to a new panel - Sherry would prefer a judge decide the best way forward.
