Dear supporters,

After careful consideration, I have decided not to pursue the appeal. Appeals have a 1/3 chance of success. As per my lawyers, the chances for me are even lower because we cannot reargue facts already argued in trial. This included, but was not limited to, evidence of Rocco's breeder, dog walker, trainer and the hotel manager who saw the sale take place. All 4 of these witnesses were neutral, with no relation to either party, who supported my application. Therefore, I was relying heavily on their evidence.

It is also financially impossible for me to pursue an appeal. The sister has asked for $212,025 in full indemnity costs from me for Rocco's case. We don't know how much of this her Honour will award. The losing party has to pay some of the winning party's costs in civil/estate litigation. The amount is not fixed and is awarded by a judge on a case by case basis.

Needless to say, the amount they have asked for is more than I could have imagined in my wildest dreams.

I am so beyond grateful for your continued support. I don't think *anyone* expected a dog ownership case to get to this level.
