Ensure Marriage Equality for Disabled Individuals in Interabled Relationships

The Issue

Hello. My name is Kourtney Prosser & I was born with Cerebral Palsy, caused by a birth injury. This has left me unable to walk and wheelchair bound. After many years of struggling with the challenges that this condition has given me, I found true love with an able-bodied man who saw beyond the wheelchair and embraced all of the things that many others didn’t.

My (now) husband and I, like any other couple, decided to express our love and commitment by getting married and have a beautiful 6 year old girl together. However, three years later, Social Security stripped me of all my benefits with no warning, despite previous assurances that everything was in order. This has left us struggling to take care of our family and deprived me of the medical insurance I desperately need.

This is not just about my husband and me; this is about thousands of disabled individuals who are penalized for marrying their non-disabled partners. The current Social Security policies unfairly discriminate against interabled couples by reducing or eliminating disability benefits if they choose to marry. This effectively forces many disabled people into a heartbreaking choice between love and essential financial support.

According to a report from the National Organization on Disability (NOD), nearly one-third of people with disabilities live below the poverty line due to such punitive measures (NOD, 2020). These policies do not just impact individual lives but also perpetuate systemic inequality.

We call upon lawmakers and Social Security administrators to revise these outdated regulations that penalize marriage for disabled individuals in interabled relationships. Everyone deserves the right to marry without fear of financial retribution or loss of necessary support services.
