Ensure Homeowners in Villas of Presley Lake Have the Right to Choose Their ISP
The Issue
As a resident of the Villas of Presley Lake in Woodstock, GA, I am deeply concerned about the lack of choice when it comes to selecting an Internet Service Provider (ISP) for our community. I believe that every homeowner should have the right to choose their ISP freely, without any interference or restrictions imposed by O'Dwyer Builder. O'Dwyer Builder signed an exclusive marketing agreement with AT&T. Other ISP require a community entry agreement to be signed by O'Dwyer; they have refused to sign any other ISP agreements.
The right to choose one's ISP is not just a matter of convenience; it is a fundamental consumer right that ensures fair access to competitive prices and quality services. By allowing homeowners to select their preferred brand or provider, we can foster healthy competition and encourage ISPs to offer better services at reasonable prices.
Currently, O'Dwyer Builder and AT&T are forcing homeowners in our community to purchase internet services exclusively from AT&T.
8.1 With respect to those AT&T Services indicated as exclusively marketed in Exhibit A, Developer will not directly market or sell any services on the Property, or allow any other party to directly market any services on the Property that compete with such AT&T services.
This practice not only limits our options but also denies us the opportunity to explore other ISPs that may better suit our needs and preferences.
During my purchase process I communicated to the O'Dwyer sales agent I work for Comcast and that I am required as a virtual employee to have Comcast as my internet service provider. The sales agent showed me the homeowners manual that stated the homeowner can select the internet service provider of their choice. At no time prior to signing the purchase agreement or during construction did the sales agent state that the builder has an exclusive marketing/community agreement with AT&T and that they would not sign entry agreements with any other ISP. The impact of this is now I have to travel daily (2 hours) to my job, which has increased my cost of living.
By granting us the freedom to choose our own ISP, we can benefit from improved customer service, faster internet speeds, and potentially lower costs. Competition among different providers will drive innovation and ensure that residents receive top-quality services at affordable rates. O'Dwyer and the HOA/management company need to sign agreements with other ISP to be in the community (behind a gate and on private property). AT&T should not be allowed to contractually restrict owners from selecting the ISP of their choosing.
Accordingly, this petition seeks support from all residents of Villas of Presley Lake who believe in consumer rights and fair competition within the telecommunications industry. Let us unite as a community and demand that O'Dwyer Builder respect our right to choose an ISP based on what we find suitable for ourselves.
