Enhance Sentencing for Domestic Violence
The Issue
I am a surviving victim of a brutal attack that nearly cost me not only my life but my mental and emotional well-beingas well. The impact stretched beyond myself, affecting my close friends and family, who felt powerless in their attempts to lift me from a dark and hallow place within my head. Through the long and drawn out process to seek justice where it was deserved, I worked closely with the prosecutor and victim's advocate, hoping justice would bring some solace.
During the sentencing hearing, however, a chilling event unfolded. As the suspect's sister stepped down from the stand, she menaced me with a threat. After the suspects was given his sentence of 30 years in a maximum confinement facility in the Florida Department of Corrections, his sister was observed not only exiting the courthouse but parked across the street what appeared to be waiting for my exit. No more then twenty minutes of my arrival, I was screaming for my life again because this unnamed family member of the suspect, had attempted to hit me with her car. Yet, due to the precise wording she used, law enforcement was unable to take action against her. This inflexible interpretation of language serves as a stark reminder of how victims and survivors continue to face fear even in the supposed safety the justice process promises.
Domestic violence incidents are often fraught with complexities that demand stringent legal responses to protect victims and deter future abuse. According to the National Coalition Against Domestic Violence, nearly 20 people per minute are physically abused by an intimate partner in the United States. Strikingly, only a small fraction of these cases result in severe penalties for perpetrators.
Injunctions meant to protect victims are compromised if family members or associates of the accused can exploit loopholes in phrasing to continue harassment or threats. We must urge lawmakers and law enforcement to re-evaluate and amend the guidelines surrounding verbal threats tied to domestic violence cases. Policy revisions should empower authorities to interpret threats contextually rather than linguistically, ensuring comprehensive protection for survivors.
Furthermore, harsher sentences for domestic violence charges are essential. The judicial system needs to reflect the severity of these crimes through penalties that send a clear message: domestic violence will not be tolerated, and justice will be served.
