The Issue
My son was killed by a hit-and-run drunk driver, a tragedy that turned my life upside down and shattered our family's world forever. No family should ever have to endure the heart-wrenching pain of losing a loved one due to the reckless and irresponsible actions of an intoxicated driver. We have to do more to deter and hold accountable individuals who put lives at risk on our roads.
Current laws do not adequately reflect the seriousness of driving while intoxicated (DWI) offenses that result in death, especially when the driver flees the scene. In El Paso, TX, these offenses are not treated with the severity they deserve. We are calling for a change in the legal consequences for these offenses.
Specifically, we propose that a first-degree felony charge be applied to first-time DWI offenses causing death, including incidents where drivers flee the scene. Alongside this, we advocate for a minimum bond of $350,000 to underscore the gravity of the crime. Furthermore, we believe that mandatory alcohol and drug testing should be imposed immediately upon arrest, without requiring a judge’s order.
Statistics have shown that harsher penalties can deter potential offenders. In Texas alone, thousands of lives are lost every year due to drunk driving, and too often, offenders escape severe consequences. By implementing more stringent laws, we can provide a powerful deterrent and safeguard our roads.
We ask lawmakers in El Paso to take urgent action to revise these laws to better protect our community and ensure justice for victims and their families. Holding offenders accountable not only offers some solace to families like mine but also sends a strong message that our community will not tolerate such negligent behavior.
