Enforcement of ADA and Fair Housing Law Compliance for Residential Complexes in Gilbert,AZ

The Issue

We, the undersigned, respectfully petition the Town of Gilbert to take immediate and enforceable action to ensure all multifamily housing developments within the town—specifically including Quintana at Cooley Station by Mark-Taylor—are in full compliance with the Americans with Disabilities Act (ADA), the Fair Housing Act (FHA), and all relevant Arizona state laws protecting individuals with physical and mental health disabilities.

Background:
Residents with disabilities frequently encounter barriers to accessible housing. There are credible concerns that properties such as Quintana at Cooley Station do not meet basic accessibility or accommodation standards as required by federal law. Furthermore, advertising units as “ADA compliant” without meeting those standards misleads tenants and violates consumer and civil rights protections.

We Request the Following:

  1. Mandatory ADA and Fair Housing Compliance Audits
  2. Annual accessibility inspections for all multifamily housing complexes.
  3. Verification that units and common areas meet ADA and FHA design standards.
  4. Enforceable Penalties for False Advertising
  5. Fines and sanctions for falsely labeling units as ADA accessible.
  6. Legal accountability for misleading or discriminatory lease terms.
  7. Transparent, Disability-Friendly Leasing Terms
  8. Inclusion of reasonable accommodation procedures in leases.
  9. Required disclosure of tenant rights under federal and state law.

Oversight and Complaint Resolution

  1. Establishment of a town ADA/Fair Housing Ombudsman.
  2. Safe, retaliation-free pathways for tenants to file accessibility complaints.

Future Tenant Protections
- Required Disability Access Compliance Plans for new developments.
- Periodic unannounced inspections with tenant input.

Conclusion:
